The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On August 31, 2021, Chuck Kirchner conducted a comprehensive inspection of the Mark Moldenhauer Yard Waste
Notification on Lystra Road in Chapel Hill, Chatham County. 1. The yard waste notification (YWN) is located atop a portion of a notified land clearing and inert debris (LCID) landfill (N0193) that has been covered with soil and is no longer in operation. 2. The property (parcel No.: 67592) is owned by Couch Etta C. Heirs, Edna R. Council, Marjorie C. Laney & Joan E. The property owner contact listed on the current YWN facility renewal form is Joan Spencer (ph. 919-477-6617). 3. The facility is posted ‘not open to the public’. Moldenhauer Landscaping, Inc. uses the YWN/property for its business. 4. Mulched woody material, logs separated off to the side, stone and concrete observed on site during this inspection.
5. Adequate equipment observed on site for all YWN needs. 6. All woody material was mulched at the time of inspection. 7. Mulch is available to the public. 8. The facility maintains records of the amount of material received. Throughput records were provided for 2021. LCD material brought in so far for 2021 is 2,634 cubic yards. 9. Mr. Moldenhauer stated that there was ~ 2,400 yd3 of mulch on site.
10. Material accepted is required to be less than 6,000 yd3 quarterly, processed and unprocessed combined. 11. The operation must remain < 2 acres in size. 12. The facility appeared to meet required setbacks. 13. Recommend keeping a fire access lane around all sides of LCD/mulch material in case of fire. 14. Soil is stockpiled for reuse adjacent to the YWN operation. Mr. Moldenhauer stated that the soil is screened before use. The soil is used by Moldenhauer Landscaping, Inc. 15. Concrete and rock are stored for reuse at the far end of the lot. The concrete and rock are used by Moldenhauer Landscaping, Inc. 16. Mr. Moldenhauer previously stated that logs stored on site are routinely brought to a sawmill. 17. No erosion or runoff was observed this inspection. 18. Access roads are of all-weather construction. 19. The site is secured by a metal gate with lock. 20. The facility has a good sign. 21. The yard waste facility notification shall be renewed annually by June 1st.
