STATUS OF PERMIT:
In 1973. Landfill operations began in Phase 1 on this property. Facility Permit 51-03 is a combination of facility permits
51-01 and 51-02.
Permit to Construct Johnston County MSW Landfill, Phase 6 issued May 8, 2020.
Permit to Operate 5103-MSWLF Phase 4A and 5103-CDLF Area 2 Cells 1 and 2 issued May 8, 2020.
Permit for Closure for MSW Phases 1 through 4 and C&D Area 1 issued May 8, 2020.
Life of Site Permit for 5103-MSWLF and 5103-CDLF issued May 8, 2020 and will expire August 8, 2057.
PURPOSE OF SITE VISIT:
Partial Compliance Inspection
STATUS OF PAST OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1626 (8)(d), "Leachate shall be contained within a lined disposal cell or leachate collection
and storage system."
CORRECTIVE ACTIONS IN PROGRESS: The Johnston County Landfill is in violation of 15A NCAC 13B
.1626 (8)(d) in that leachate was not contained within a lined disposal cell or leachate collection and storage system.
On January 21, 2021, Mr. Rick Proctor contacted Amanda Thompson to self -report a leachate release. The release
was reported to Mr. Proctor by an operator at the end of the day on Wednesday, January 20, 2021. The release was
located at the southern end of Phase 5, adjacent to the gas collection lines. Mr. Proctor stated that pressure on a pipe

had blown a cap off the end of the pipe and forced leachate out of the pipe. During the inspection, Mr. Overby stated
that during the repair of the pipe, Mr. Rick Proctor had found a tear in the liner. Mr. Proctor had submitted a request
to get the liner repaired. Mr. Overby stated that the liner would be repaired within the next few weeks. Water from
the 1.5-inch rain fall from the day prior, was identified within the excavation. Mr. Overby contacted a worker to
bring the pumper truck to the excavation to pump out the water and take it to the lift station for proper disposal.
OBSERVED VIOLATIONS:
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The facility is fenced and is secured by a locking gate when it is not open for operation.
2. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact
information as well as materials accepted at the facility.
3. The facility accepts waste Monday through Saturday from 8:00 am until 4:45 pm and closed on Sunday.
4. The permit, and operations plan, and records were not reviewed during this inspection.
5. The landfills had no woody vegetation and were mowed.
6. Permanent edge of waste (EOW) markers were observed around the active portion of the MSWLF and closed
CDLF.
7. The perimeter roadway around the active MSWLF and closed CDLF are being properly maintained. Additional
crush and run with mulch had been added to the active MSWLF roadway so that vehicles dumping at the working
face are not getting stuck in the mud.
8. Photographs were taken during this inspection.
Phase 5 MSWLF
9. Mr. Overby stated that Phase 5 would be reopened and utilized for MSWLF waste, due to certification issues with
Phase 6. Mr. Overby stated that signage had already been installed and crush and run for the roadway had been
piled at the location. The construction of the haul road and opening of Phase 5 would likely begin the week of
August 23, 2021. Recent rains had caused ruts to form in the existing portion of the haul road to Phase 5. Mr. Overby
stated that the roadway would be repaired during the construction of the haul road to the top on Phase 5.
10. The EOW markers were not visible around Phase 5. Mr. Overby stated that the visible red fiberglass pole, was the
location of the EOW marker that had been damaged during the mowing of Phase 5. Mr. Overby stated that he would
have new EOW markers installed. The EOW markers around the active MSWLF and closed CDLF were visible.
11. No areas of subsidence or ponding water were observed on Phase 5.
MSWLF
12. During this inspection, mulch was being applied along the southern side slope of the active MSWLF to stabilize the
soil.
13. Erosion rills were also identified along the southern side slope. Mr. Overby stated that they were in the process of
covering the rills with soil and stabilizing with mulch. Several leachate seeps were identified within the rills. The
leachate had not left the edge of waste. Ms. Thompson stated to Mr. Overby that the leachate needed to be stopped
immediately. Mr. Overby contacted an equipment operator to repair the leachate seeps. Mr. Overby provided Ms.
Thompson with photographs of the repairs on August 20, 2021.

14. The working face at the MSWLF appears to be kept small and appeared to be well compacted with no unacceptable
wastes observed. Mr. Overby stated that the cover dirt located adjacent to the working face was from the cleaning
of the drainage ditches along the haul road.
15. Areas of exposed waste were identified along the side slopes of the MSWLF. Mr. Overby stated that they were
working on covering the side slopes with soil and stabilize them with mulch. Continue to cover and stabilize the
side slopes as needed to cover the exposed waste.
Phase 6 MSWLF
16. Phase 6 has been constructed to the west of Phase 5 of the MSWLF. Mr. Overby stated that there had been an
issue with the submittals required by the Section Permitting Staff, which is why a pre -op meeting had not been
set. Keep the Section updated as to when a pre -op meeting can be set for Phase 6.
Yard Waste
17. The previously identified low areas within the yard waste area had been filled and graded to shed water. A low-
lying area was identified near the riprap near the northeastern corner. Mr. Overby stated that the recent rains had
identified any additional areas that would need to be filled in a regraded.
18. The yard waste has been ground and windrowed. The yard waste had been ground and was being utilized to
stabilize the side slopes of the active MSWLF.
19. The active yard waste area is located to the west of the access road.
20. No unacceptable waste was observed within the waste stream. Landfill staff were in the yard waste processing
area when yard waste loads were dumped.
