PURPOSE OF SITE VISIT: Operational inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 1. CORRECTIVE ACTIONS IN PROGRESS: 15A NCAC 13B .0566(8) states: "Surface water shall he diverted from the working face and shall not be impounded over waste. " During the inspection standing water was observed in the east end of the landfill where trucks are instructed to empty their loads. Hwy 3 LCID LLC is in violation of 15A NCAC 13B .0566(8) for failure to divert all surface water from the working face. This area was pointed out to Mr. Mills and he stated he would bring over a pump and hose to pump the storm water out and install a drainage pipe to divert the storm water. Page 1 of 5 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section To achieve compliance, Hwy 3 LCID LLC must drain all standing water from the landfill by September 1, 2021. 2. CORRECTIVE ACTIONS IN PROGRESS: 15A NCAC 13B .0566(9) states: "Solid waste shall not be disposed of in water ". During the inspection a customer was unloading a trailer of wood waste and the equipment operator was moving wood debris into the standing water in the east end of the landfill. Hwy 3 LCID LLC is in violation of 15A NCAC 13B .0566(9) for disposing solid waste in water. Mr. Mills stated he would have his equipment operator move all the wood debris from the standing water and to clear an area for the drainage pipe to be installed. To achieve compliance, Hwy 3 LCID LLC must drain all the standing water from the landfill and ensure no solid waste is disposed of in water by September 1, 2021. Submit a plan for diverting surface water away from the disposal area of the landfill so that future rain events do not cause waste to be disposed of in water. The plan should be provided by e-mail to Kim Sue at: kim.sue(&ncdenr.gov by September 1, 2021. Solid waste in standing storm water located in the east end of the landfill. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Site consists of a Notified Land Clearing and Inert Debris Landfill. The facility is approved for the disposal of land clearing waste, concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood and yard trash. 2. Access to the site had a concrete entrance and is secured by a gate. 3. A sign had been installed at the entrance of the site detailing acceptable wastes, hours of operation, contact name and phone number for emergencies. 4. A building for the site attendant is still under construction but finished enough to be occupied. Janice Harmon is the site attendant. An operator shall be on duty at all times while the site is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes. 5. The entrance roadway is of all-weather construction, made of compacted stone, and was found to be in good condition at the time of the inspection. 6. Edge of waste markers were installed around the perimeter of the landfill. Additional markers were installed thirty feet outside of the edge of waste. These thirty foot offset markers will allow the facility to reinstall any edge of waste markers that become damaged or displaced. 7. During the inspection water was observed ponding at the bottom of the landfill disposal area. Waste had been Page 4 of 5 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section placed in the ponding water. (See observed violations section of this report for additional information.) 8. It is recommended that landfilling operations take place at the western end of the excavated area, where the ground elevation is higher. This would allow the fill area to drain naturally downhill to the eastern end of the landfill. Ideally, waste should be moved from the tipping area to the western end as it arrives. This would be an effective means of ensuring waste is not disposed of in water. 9. The facility appears to meet the buffer requirements, as stated in 15A NCAC 13B .0564 (6), of a minimum of 50 feet from the waste boundary to surface water and 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells. 10. Solid waste in the landfill shall be compacted and slopes shall not exceed a ratio of 3:1 at any time. The excavated slopes were observed to be steeper than 3:1. Ensure the grade of excavated slopes is reduced to a maximum of 3:1. 11. It is required that all waste shall be covered with no less than 6 inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. 12. It is recommended a cover log shall be established that includes the date that monthly cover is applied to all of the waste in the landfill. The log may also include the amount of soil used to achieve the minimum 6" cover and the man hours spent, if desired by the landfill operator. The cover log should be maintained in the landfill office so that it is available for review upon request.
