Hello Nathan and Nelson,
I've completed review of the response to comments for the Phase 5 site suitability, and comments are below:
Characterization map. Fig. 1- The floodplain is hard to follow; please add light shading/dots, not tight lines. Fig.
3 - label the yellow area.
Location Restrictions:
a. Wetlands - for the application text, also include a summary description of the wetlands determination
and permitting, and describe compliance with rule .1622 (3).
b. Fault areas, seismic impact, and unstable areas - The application text should describe compliance with
the .1622 rules. Include maps and diagrams, as applicable. For guidance -

c. State Nature & Historic Preserves - The State Nature & Historic Preserves refers to a specific list of
identified historic/nature sites in North Carolina. Sites on the list include historic sites such as the
Alamance Battlefield, and nature areas, including NC State parks, nature preserves, and recreation
areas. The statute and list can be found at this link -

application text should address compliance with this rule, and provide communication from the Natural
Heritage Program for this requirement.
d. Water Supply Watersheds - The application text should discuss compliance with Rule .1622 (9). Provide
the surface water classifications for the water bodies receiving discharge from the

e. Endangered Species - The application text should discuss compliance with Rule .1622 (10), and refer to
the report in the appendix.
3. Section 7 - Traffic Study- The application text should also state that the state requirement, in accordance with
NCGS 130A-295.5 (a) and (b), for the traffic study has been met, or is in compliance.
4. Facility Plan:
a. The tons per day and franchise approval should be updated, two sections.
b. Rule reference .1619 (E)(1) should be changed to .1626 (1) and (9).
5. EA report - Discussion of wetland impacts and endangered species, and attachments, and references to figures,
should be updated regarding the more recent correspondence and permitting.
6. EJ report - Since the last permit action, there has been E J report guidance issued by our Department. The EJ
report for this application will need to meet the new guidance, at this link
