STATUS OF PERMIT:
A Permit to Operate Shotwell Landfill, Phases 1, 2, 3, 4 and 5, (9226-CDLF-2020) was issued to Meridian Waste North
Carolina, LLC (Owner) and Shotwell Landfill, Inc. (Operator) on June 8, 2020 and will expire on January 10, 2061. A
Permit to Construct Shotwell Landfill, Phase 6, was issued to Meridian Waste North Carolina, LLC (Owner) and Shotwell
Landfill, Inc. (Operator) on June 8, 2020. The initial, substantial, construction authorized by the permit to construct must
commence within 18 months from the issuance date of the permit (by December 8, 2021). If substantial construction
does not begin within 18 months from the issuance date of the permit, then the permit to construct shall expire.
Permit Approval to Construct Shotwell C&D Material Recovery Facility (9226-MWP-2020) was issued to Meridian
Waste North Carolina, LLC (Owner) and Shotwell Landfill, Inc. (Operator) on November 6, 2020. The initial,
substantial, construction authorized by the Permit to Construct must commence within 18 months from the issuance date
of this permit. If substantial construction does not begin within 18 months from the issuance date of this permit, then the
permit to construct shall expire.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
Shotwell Landfill is a construction and demolition landfill, C&DLF, located at 4724 Smithfield Road, Wendell, Wake
County, North Carolina. The facility has received a permit to construct Phase 6 of the landfill, however, as of the date of
this inspection, construction had not begun. The facility has also received a permit to construct a Mixed Waste Processing
facility, which also had not yet begun construction.
The site was inspected by Davy Conners and Amanda Thompson on August 19, 2021. Tim Webb with Meridian Waste
accompanied Ms. Conners and Ms. Thompson for the inspection. The following was observed:
This inspection was the result of an odor complaint received by the Section earlier that week. Upon approaching
the facility, Davy Conners observed a hydrogen sulfide (rotten egg) odor from the road, around where the property
begins. During the inspection, the hydrogen sulfide odor was most notable and strong along the back slope of the
C&DLF where there is no vegetative cover and the soil cover has eroded. Within 10 days of this report, cover
any areas of erosion with at least 6 inches of soil to control odors, and submit the two most recent Landfill
Gas Monitoring reports to Davy Conners at davis.conners(&ncdenr.gov.
2. During the April 29, 2021 inspection, the working face of the C&DLF was over a half -acre in size and a large
area of the top of the landfill outside the working face had exposed waste. During the August 19, 2021 inspection,
the working face was within a half -acre in size and soil was piled nearby for cover. Good job. There were still
some areas outside of the working face with exposed waste (Figure 1). Within 10 days of this report, cover
with at least 6 inches of earthen material or pick up any exposed waste on the top of the landfill outside of
the working face.
3. There was a small amount of windblown along the landfill access road. Mr. Webb said they collect windblown
daily but were unable to the day prior to the inspection due to heavy rains. Mr. Webb sent photos of the area
having been picked up later that day.
4. Per 15A NCAC 13B .0542 (k) (2), "Adequate sediment control measures consisting of vegetative cover, materials,
structures or devices must be utilized to prevent excessive on -site erosion of the C&DLF facility or unit."
And per the permit, "All sedimentation and erosion control activities must be conducted in accordance with the
Sedimentation Control Act, NCGS 113A-50 et seq., and rules promulgated under 15A NCAC 4. All required
sedimentation and erosion control measures must be installed and operable to mitigate excessive on -site erosion
and to prevent silt from leaving the area of the landfill unit during the service life of the facility. The Section must
be notified of any modifications to the approved sedimentation and erosion plan."
During the inspection, areas of erosion rills on some side slopes were observed, including some areas where the
erosions cut through the cover to expose waste (Figures 1 and 2). This issue was also noted in the April 29, 2021
report, however the areas observed during that inspection had been repaired. Recent heavy rains contributed to
erosion. Additionally, a large amount of sediment was observed in the sediment pond and forest (Figures 2 and
3). The trees where this sediment has accumulated have died. Within 10 days of this report, reestablish 6
inches of earthen cover on areas impacted by erosion. Within 30 days of this report, begin to implement
measures such as those listed above to prevent erosion. And within 30 days of this report, make necessary

changes to be in accordance with the site's sedimentation and erosion control plan and notify the Section
of any changes made to that plan.
5. Per the permit, "This facility is permitted to receive solid waste generated within Wake and Johnston counties as
described in the franchise application approved by Wake County on September 5, 2006. The facility is approved
to accept 91,250 tons per year or approximately 250 tons per day, based on 365 operating days per year, in
accordance with the approved franchise granted by Wake County. Maximum variance shall be in accordance with
NCGS 130A-294(bl) (1)."
In April 2021, the Section received a complaint that the landfill was accepting more waste than the franchise
agreement and permit allowed. A meeting was held with Section staff and Meridian Waste staff to discuss the
use of wood waste as "recycled material" in the landfill. The Section will be following up with a separate letter
to address this issue.
6. Per the permit, "The edge of the waste footprint for all disposal units must be identified with permanent physical
markers."
During the inspection, no edge -of -waste markers were observed. This issue was also noted in the April 29, 2021
inspection report. Within 30 days of this report, install markers clearly identifying the edge of waste at the
facility.
7. Per 15A NCAC 13B .0542 (1) (2), "Surface water must not be impounded over or in waste."
During the inspection, water was observed ponding on top of the landfill (Figure 4). In addition, a large volume
of water was ponded along the interior of the access road (Figure 5). Since there are no edge -of -waste markers,
it is unknown if this water is ponding in/over waste. Within 10 days of this report, regrade these areas to
promote drainage, in accordance with the site's sedimentation and erosion control plan.
8. During the inspection, tall grass was growing on the inactive portion of the C&DLF, to the point that inspecting
this area was not feasible (Figure 6). Within 30 days, mow the landfill to allow for inspection.
9. Records were not reviewed during this inspection.
10. Per § 130A-309.05. (c) (1), "Seventy-five percent (75%), by weight or volume, of the recovered material stored
at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through
sale, use, or reuse by December 31 of the same year."
During the inspection, a large amount of land clearing waste was observed being stored at the facility. During
the previous inspection, Mr. Daher said they had not ground land clearing waste since taking ownership of the
property and the waste has been accumulating since June 2020. Make sure you are grinding and using the land
clearing waste stored onsite, to be in accordance with the above reference General Statute.
