Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Excess vegetation has been removed from around the field markers. However, the 10 feet setback needs to be re-established along the west side of the site. The required setbacks from the permitted disposal fields are 50 feet towards a property line on the north side, 50 feet towards the railroad and 10 feet from neighboring vegetation on the south & west sides. 2. Noted scattered cluster of weeds & vegetation other than Bermuda on both fields. Field 2 has been harvested & is currently in use. Field 1 has taller vegetation. Harvest the fields this fall & establish the winter cover crop per the approved nutrient management plan. No damaged areas from grease application or heavy application were noted during this visit. 3. The required field posts are present. The approved setbacks were not measured at this time, but appear accurate. No sign of land application outside the permitted boundaries. No sign of heavy or recent application No odors noted. 4. The required signs are posted and the access road is adequate at this time. 5. Site logs were reviewed and it appears that the required information is being maintained at this time. However, it appears that Field 2 was used significantly more than Field 1 and that the field rotation (per the nutrient management plan) was not followed thru the growing season. 6. Mr. Locklear stated that he had attended a continuing education class in Shallotte to obtain the required 4 hours of firm training and the 3 hours of land app training. 7. Thank you for your time.
