STATUS OF PERMIT:
640 1 -MSWLF- 1983 (Closed): The MSWLF ceased accepting waste during the summer of 1998, closure was documented
in a CQAR prepared by GEI Consultants and dated December 1998.
6401-CDLF-1999 (Closed): Locate on top of the closed MSWLF landfill (6401-MSWLF-1983), construction and
demolition waste was accepted until 2000, final closure was documented in a CQAR prepared by GEI Consultants and dated
March 2000.
6403-CDFL-2000: Permit to Construct Phases 5-9 and Permit to Operate Phases 1-4 was issued July 13, 2020, and the
estimated life of the landfill is approximately through 2053.
PURPOSE OF SITE VISIT:

STATUS OF PAST NOTED AND OBSERVED VIOLATIONS
A. 15A NCACI313.1626 (8)(b), "Surface water shall not be impounded over or in waste."
PARTIALLY RESOLVED: The County has cut the side slope berms of 6401-MSWLF-1983 in several places to help

alleviate the previously identified areas of standing water over waste. The Section was able to observe the cut areas of
the berms from a distance. Additional gravel or riprap will need to be added to the cuts, as needed, in order to control
erosion. The cut areas will need to be monitored and repaired as needed to prevent erosion and standing water. Any
additional areas of standing water will need to be filled and/or properly graded to shed water. A follow-up inspection
will be conducted to determine if the areas of standing water over waste have been alleviated.
B. §130A 309.05 (c)(1), "Seventy-five percent (75%), by weight or volume, of the recovered material stored at a
facility at the beginning of the calendar year commencing January 1, shall be removed from the facility through
sale, use, or reuse by December 31 of the same year."
And §130A 309.05 (c)(4), "The recovered material shall not contain significant concentrations of foreign
constituents that render it unserviceable or inadequate for sale, or its intended use or reuse."
RESOLVED: The burned yard waste has been removed from the area across the service road from 6403-CDLF-2000
(Phase 4). No unacceptable wastes were observed. Mr. Ben Barnes stated that the area would be graded and seeded to
prevent erosion.

C. 15A NCAC 13B .0542 (k) (1 and 2), "Adequate sediment control measures consisting of vegetative cover,
materials, structures or devices must be utilized to prevent sediment from leaving the C&DLF facility... (and)
prevent excessive on -site erosion of the C&DLF facility or unit."
PARTIALLY RESOLVED: During this inspection, the sediment basin, located to the north of 6403-CDLF-2000
(Phase 4), was still in need of being cleaned out. Based on previous correspondence, the sediment basin was scheduled
to be cleaned out in the Spring of 2021. The sediment basin has not been cleaned out yet. The basin should be restored
to ensure the basin functions properly. Overgrown vegetation was still present along the slopes of and to the west of the
sediment basin. The overgrown vegetation had recently been mown between the sediment basin and the haul road;
however, not the slopes of the sediment basin. The slopes of the sediment basin should be mown to allow access during
sample events and proper inspection. Mr. Barnes had installed the additional E&S controls around the inlet to the
sediment basin. Mr. Barnes stated that the pressure of the stone had bent the poles supporting the fabric barrier. Mr.
Barnes had submitted a request to purchase and install additional poles. No filter stone was observed within the sediment
basin inlet. The water within the sediment basin appeared to be clearer than previous inspections. Please contact
DEMLR if there are additional questions regarding the inlet to the sediment basin. The sediment basin must be cleaned
out within 30 days from receipt of this report.

OBSERVED VIOLATIONS
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
1. Four edge of waste (EOW) markers had been installed around Phase 5 of 6403-CDLF-2000. Mr. Barnes stated that
he would be purchasing additional edge of waste markers to increase the EOW marker visibility.
2. Recent rains had created ponding within Phase 5. Mr. Barnes stated that the water from the cell was pumped out
and into the drainage ditch as approved. It was recommended during the inspection that a berm be installed between
the waste and the open portion of Phase 5, to separate the leachate from the stormwater. The stormwater could be
pumped into the drainage ditch; however, the leachate would need to be removed and treated at the wastewater
treatment plant. The berm could be advanced in front of the waste. Mr. Barnes stated that he anticipated covering

the waste every day and did not anticipate any leachate within the cell. It was still recommended that the berm still
be constructed as a safety measure in case the waste was not covered every day.
3. A berm had been installed to protect the over excavated areas along the southern and western edges of Phase 5,
between the access road and the new cell. The berm had been installed to prevent customers from accidently driving
off the access road. The installation of the berm was approved by Permitting.

EOW were visible on the closed and active cells of 6403-CDLF-2000.
Recommend reviewing the sedimentation and erosion control plans for this facility and ensure that approved
measures are constructed properly and in place as required. Basins impacted by excess sediment should be cleaned
out, restored to plan specifications and properly maintained.
The CDLF working face was compacted and under the %2 acre size limit. Cover was being applied during this
inspection. Ensure that six (6) inches of earthen material is applied once weekly or when the working face reaches
1/z acre in size.
The metal recycling pile had grown since the previous inspection. Mr. Barnes stated that he had recently contacted
the contractor to come and remove the metal recyclables. Continue to ensure the proper management of the metal
recycling area.

Some dust was being generated from vehicles traveling on the access road. Nash County had recently purchased
and modified a water trailer to spray water onto the access road to prevent dust. Ensure that the water trailer is
utilized to minimize dust from the access road.
Lush vegetation was observed on the inactive portion of the CDLF. Ensure that the inactive CDLF is mown as need
to allow for proper inspection. Also ensure that woody vegetation is removed from the side slopes so that the cap is
not disturbed.
