Permitting documents indicate deed notification occurred December 7, 2006. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NONE OBSERVED VIOLATIONS: NONE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS A copy of the new LCID rules, which became effective on January 1, 2021, are provided with this report. Please read through the rules and contact me if you have any questions. Based on rule 15A NCAC 13B .0563 (6), within 5 years of the effective date, notified LCID landfills will need to be properly closed or obtain a permit from the Division of Waste Management. Please contact me to discuss the requirements to properly close the LCID. 1. The facility is a notified land clearing and inert debris (LCID) landfill. The disposal area for the notified LCID landfill shall remain under two (2) acres. 2. The site is located on parcel 2290001202. Permitting documents indicate deed notification occurred on December 7, 2006. 3. The facility is properly secured with a locked gate. 4. 15A NCAC 13B .0201 (g), “Disposal area boundaries for landfills permitted in accordance with Sections.0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker.” Edge of waste markers were not visible at the time of this inspection. Permanent, clearly visible edge of waste markers must be established at the site, showing the under two (2) acres boundary for waste disposal. 5. An interior roadway has been made of all-weather construction and is being maintained in good condition. 6. There is at least a 25 foot access path around the site for fire control vehicles. 7. All setbacks are in place. 8. No standing water was observed during the inspection. 9. Inert debris (concrete, brick, and block) is being staged at the LCID landfill for future grinding and re-use.*Please note that the State rules regarding recovered materials state that for a material to qualify as a recovered material, the majority of the material (75% or more) must be sold, used, or re-used within the calendar year of placement on-site. Any inert debris not re-used within the calendar year of placement on-site, should be properly disposed in the LCID landfill. 10. Per 15A NCAC 13B .0566 (3), “All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65.” Please ensure the active working area is covered monthly, or when the active working area reaches one acre in size, whichever occurs first. 11. Remove any trees and deep root penetrating woody vegetation that may be growing over the waste. 12. Also located on this parcel is a mine. Please be aware that waste cannot be placed in surface water and must remain above the seasonal high water table. 13. No off site erosion was observed during this Facility Compliance Inspection. 14. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days receipt of this report. The SWS will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
