The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The purpose of this inspection was to confirm that the landfill was being covered and waste was no longer being
accepted at the site. All photos included were taken by Susan Heim August 13, 2021, during the inspection.
2. 15A NCAC 13B .0567(b), Closure Requirements, states in part: "The owner or operator of a site shall begin
closure activities no later than 30 days after the final receipt of wastes. Closure activities shall include....
covering the disposal area with no less than one foot of soil cover sloped to direct the flow of surface water
from the landfill [and] stabilizing the soil cover with vegetative ground cover or other stabilizing material.
.... The owner or operator of a site shall complete the closure activities within 120 days after beginning the
closure activities. "
3. The property was sold to J & K Land Management, LLC and a new deed reflecting the change in ownership
was recorded on April 14, 2021, in the office of the Davidson County Register of Deeds. Mr. Jones was notified
by the Solid Waste Section on June 30, 2021, to cease accepting waste and begin closure activities. Mr. Kemp
confirmed that no waste has been accepted at the site since that date. It is the stated intention of the new owners,
Jeff Jones and Ryan Kemp, J & K Land Management, to apply for a permit to continue operations and expand
the landfill footprint.
4. The site is secured by means of a locking gate which blocks the entrance drive, which is the only point of access
to the property for vehicles. Steep terrain and woods prevent entry elsewhere along the property boundary.
5. No signage was present at the entrance, and it was noted that a J & K employee was parked on the public
roadway leading to the site to turn away any waste hauling trucks before they could approach the landfill
entrance itself.
6. Several large dump trucks hauling clean soil entered the site during the inspection. Mr. Kemp explained that the
soil would be used to finish the required cover on the landfill.
7. A container is staged onsite for collecting unpermitted waste and any other trash accumulated by the onsite
crew.
8. No edge -of -waste markers were visible around the fill area. Mr. Kemp stated that the former owners had never
installed markers. He and Mr. Jones explained that a survey would be completed, and markers installed as
quickly as Mr. Dickey's staff could accomplish it.
9. The site was still wet in spots from frequent rain events that had occurred over the past few weeks.
10. Access roadways are constructed of compacted clay and gravel. However, portions of the entry road showed
signs of erosion. Large rills and voids where sections of the road had been washed out were evident. Once past
the entry drive, the access roadway widened and the surface was muddy in spots, but stable.
11. Mr. Kemp pointed out a new sediment basin that had been completed at the top of the entrance drive where the
roadway curves into the facility. A smaller, existing basin is located closer to the entrance gate on the north side
of the entry road. A Swale that wraps around the disposal area directs surface water to these basins. In a
conversation that took place prior to this inspection, Blane Houck, Erosion Control Inspector, Division of
Energy, Minerals and Land Resources, stated that he had inspected the site on August 10, 2021, and found that
the existing erosion control plan would need to be modified to effectively control erosion and sedimentation on
the site.
12. A large portion of the landfill had been covered, and the top of the landfill had been flattened and compacted for
use as a tipping area when the landfill was accepting waste. This area now provides access to the side slopes,
where work is continuing to reduce the slope grades and cover the remaining waste. No verification of the
required 12" depth of soil cover was undertaken during this inspection.
13. The western slope of the landfill is situated along the access roadway and is easily accessible. However, the
northern and eastern slopes are steep, and no access is available except from the top of the fill area. As a result,
it is unknown as to whether or not the required buffers have been maintained.
14. A small stockpile of logs was situated at the northwest end of the site, and Mr. Kemp explained that these
needed to be properly sized before being transported to the sawmill for further processing.
15. The middle of the site included a stockpile of topsoil and inert debris. Beside this stockpile was a mound of soil
and mixed debris. Mr. Kemp stated that he had been excavating an area that the former owners had filled. Some
painted concrete, lumber, scrap metal and plastics were observed in the debris pile. No other unpermitted waste
was observed at the facility. Ensure that all unpermitted waste is removed from the excavated debris pile

and disposed of properly.
16. The parcel adjoining the landfill property on the west was observed being excavated. Mr. Kemp explained that
soil was being mined from one small area at a time to establish the location for the construction of an
office/shop building to be used by the landfill and the grading business. He added that, as of this time, the
adjoining parcel was not being considered for use as part of the permit application for the expansion of the
landfill.
17. As discussed during the inspection, please work with Jordan Russ, Permit Engineer, to submit the permit
application for resuming and expanding landfill operations in a timely manner. Contact information for
Mr. Russ was provided during the inspection.
