RESOLVED: 15A NCAC 13B .1626(2)(a) states: "Except as provided in Sub -Item (b) of this Item, the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging . During the inspection of Unit I, Phase 2, Cell 1 an area southwest of the working face was observed to have inadequate cover. Facility staff stated that they were working back towards that area. Gaston County was in violation of 15A NCAC 13B .1626(2)(a) for failure to cover disposed solid waste with six inches of earthen material at the end of each operating day at the MSW landfill. Facility staff provided photographic documentation on Monday, August 16, 2021, at the end of the working day via text message and email showing adequate soil was applied to exposed waste located southwest of the working face of the landfill. Page 2 of 5 FACILITY COMPLIANCE INSPECTION REPORT 20 Division of Waste Management P-W Solid Waste Section 2. 15A NCAC 13B .1626(2)(c) states: `Areas which will not have additional wastes placed on them for 12 months or more, but where final termination of disposal operations has not occurred, shall be covered with a minimum of one foot of intermediate cover". During the inspection of Unit II, Phase 2, waste was observed to be exposed in several areas on the western side slope. Heavy rain events had caused erosion on the slope, and rills had developed that were deep enough to expose waste. Facility staff stated operations on this portion of Unit II had been closed out. No further waste will be placed in this area until a new cell is designed, approved and constructed that will connect Unit II to Unit I. Gaston County is in violation of 15A NCAC 13B .1626(2)(c) for failure to maintain a minimum of one foot of intermediate cover. Photos taken by Kim Sue The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day maybe assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance of the facility. 2. The facility is permitted to receive solid waste generated within Gaston County and the area encompassed by a radius of 100 miles extending from the Gaston County line. 3. The facility accepted an average of 617 tons per day from July 1, 2020 — Dec. 31, 2020 at the MSW LF. 4. The facility accepted an average of 290 tons per day from July 1, 2020 — Dec. 31, 2020 at the C&D LF. 5. The facility is currently working in Unit 1, Phase 2, Cell 1. 6. The working face was small and manageable. 7. Metal had been removed and set aside to be moved to the scrap metal collection area. 8. Edge of liner markers were observed. 9. The facility utilizes soil and spray -applied mortar coating (SMC) as alternative cover. Soil cover is applied at least once a week and more often when deemed appropriate. 10. Working face less than'/2 acre in size. 12. The facility utilizes soil for cover which is applied weekly. 13. No ponding of water on the landfill was observed. 14. Waste was observed along the roadway into the landfill where drivers secure trailer doors. Mr. Cloninger immediately radioed staff to pick up the waste. 15. Tires had been removed from the working face and set to the side to be moved to the tire collection area. Metal had also been removed and set aside to be moved to the scrap metal collection area. White Goods & Scrap Metal Collection Area 16. Area is well maintained. 17. White goods are staged upright on a concrete pad. 18. CFC's are removed from all white goods by Rapid Recovery of Monroe, NC. 19. Scrap metal is collected by Web Metal for recycling. Scrap Tires 20. Scrap tires are collected and stored in US Tire semi -trailers. 21. Facility had two trailers on -site. One was full and during the inspection US Tire swapped out an empty trailer and took the full trailer back to their facility. 22. Area is well maintained. Electronics Recycling 23. All electronics are staged by county staff prior to being taken for recycling by ERI. 24. During the inspection all electronics were palletized and wrapped. 25. Area is well maintained. Small Type I Composting 26. Attendant on duty checks all incoming loads. 27. Only yard waste, silvicultural waste, untreated and unpainted wood waste is accepted and ground into mulch. 28. Area was well organized and maintained. 29. Henson's, Inc. was staging their equipment on -site to begin grinding. Records Review 30. A copy of the current permit and operations plan are maintained in the landfill office. 31. 1st and 2nd Semi-annual groundwater monitoring 2020 were reviewed for Unit II, Phase 1 & 2, 1st and 2nd Semi- annual groundwater monitoring 2020 were reviewed for Unit 1, Phase 1, 1' and 2nd Semi-annual groundwater monitoring 2020 were reviewed for C&D. 32. Reviewed 3rd Quarter 2020, 4th Quarter 2020, 1st Quarter 2021 and 2nd Quarter 2021 methane reports. 33. Waste screening reports were reviewed. Facility staff perform one (1) random inspection each day at the MSW and C&D LF. Records reviewed were from January 1, 2020 to July 1, 2021. Unacceptable waste and final disposal was noted. Leachate lines have been cleaned and camera inspected and HDR is reviewing the footage. 3. Filter fabric over leachate lines to be folded back when waste is placed. It was discussed and recommended making a note in the operating records when this is done. 4. Fluff layer will be 10' in thickness. 5.
