The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS: 01 – This site is recorded in the Hertford County Register of Deeds Book 708, Pages 99 (7) and 100. Document #
301695. Stamped and signed on December 30, 2008. 02 – Facility has a locking gate for security and there is a V-ditch on the road frontage to prevent access to the facility. 03 – Facility has adequate signage. 04 – If the Fred Smith Company now owns this site, need to send information to permitting with a New Application filled out. (See next 2 lines for information.)
05 – Attached to the email sent with this inspection report are ALL of the 2021 Re-Adopted Rules for LCIDLF’s (15A NCAC 13B .0563 thru 15A NCAC 13B .0567) that were effective on January 01, 2021.
06 – Please take time to review the above rules as they will effect this facility within 5 years. 07 – There was no non-conforming waste on the LCIDLF today. 08 – The landfill was small and had been covered with earthen material.
09 – Stockpiled earthen materials were on-site for future cover material. 10 – Overall facility looks good. 11 – Digital pictures were taken during this inspection and some are attached to this report.
