STATUS OF PERMIT:
The Large Type 3 Permit was issued on February 14, 2019. The permit will expire on February 14, 2024.
Wind River Environmental is identified as the operator in the permit.
PURPOSE OF SITE VISIT:
Technical Assistance Meeting
STATUS OF PAST NOTED VIOLATIONS
A. 15A NCAC 13B .1406 (3), "Stormwater shall be diverted from the operations area."
And Permit to Operate, Attachment 3 (18), "An appropriate Division of Energy, Mineral and Land
Resources (DEMLR) permit for managing any stormwater and/or wastewater at the facility must be
maintained as required. Any leachate generated at the facility and any runoff from the facility must be
managed to prevent contamination of groundwater and surface water. The facility must be maintained to
prevent the accumulation of stormwater and leachate on composting areas, storage areas, and roads."
RESOLVED: The windrows had been reorientated and were running parallel to the slope. The areas between the
windrows had also been graded to shed water away from the windrows. A low spot was observed near the eastern

end of the southernmost windrow. Nick stated that he would fill the low spot and grade the area to shed water.
Continue to monitor and repair the area as needed to promote the shedding of surface water.
B. 15A NCAC 13B .1406 (4), "Leachate shall be contained on site or treated prior to discharge. A National
Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC
02B prior to the discharge of leachate to surface waters."
RESOLVED: Mr. Farrell stated that a berm had been constructed prior to the drainage ditch to catch any leachate
and surface water. The water that collected in the berm would be removed with an on -site pumper truck and
placed into the dewatering system. The water would then be distributed onto the adjacent septage application field
after completing the dewatering process. Mr. Cobb, Environmental Senior Specialist who inspects the septage
application site, also approved of this method. Mr. Cobb also stated that nutrient loads may need to be recalculated
with the addition of the leachate/surface water to the dewatering system.
ADDITIONAL OSERVED VIOLATIONS
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
Mr. Farrell requested a meeting to discuss the corrective actions taken and need to be taken to resolve the above violations.
Mr. Farrell stated that Dr. Albert Rubin, Soil Scientist and Agronomist Professor from NC State, had inspected the Site
on Thursday, August 5, 2021. Dr. Rubin would assist Wind River by developing a sampling plan for the facility. Mr.
Farrell verbally requested on August 6, 2021, and in written form on August 9, 2021, an extension until August 13, 2021,
to properly prepare the soil sampling plan. The Section approved the extension on August 9, 2021. The sampling plan
should be submitted in electronic format sent via email to Donna Wilson at donna.wilsonkricdenr.gov, Christine Ritter
at Christine.ritterkncdenr.gov and Amanda Thompson at Amanda.thompson&ncdenr.gov.
Dr. Rubin had also suggested the construction of a berm so that leachate and surface water is collected prior to discharge
from the Site. The berm was constructed during Dr. Rubin's visit on August 5, 2021.
Mr. Farrell stated that Nick had reorientated the windrows the day after the NOV was received by Wind River. Nick
would also be monitoring the facility and grading as needed to ensure that surface water is shed away from the windrows.
The soil sampling plan was submitted to the Section for approval on August 13, 2021. The sampling plan was approved
by Ms. Christine Ritter, the Section hydrogeologist for Franklin County, on August 16, 2021. After the sampling plan was
approved, Dr. Rubin stated that he may not be able to get the pathogen sample to the lab within the hold time and requested
approval from the Section to change the laboratory for the pathogen analysis. Ms. Christine Ritter approved the laboratory
change on August 17, 2021.
Continue to remove any unacceptable wastes identified within the windrows.
