Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS On August 13, 2021, Chuck Kirchner met with Ricky Beal to conduct a comprehensive inspection of the Ricky Beal Grading & Septic Tank Service LLC LCID Landfill on Walter Lambert Road in Goldston, Chatham County. 1. The Ricky Beal Grading & Septic Tank Service LLC LCID Landfill is a notified land clearing and inert debris (LCID) landfill. 2. The LCID landfill is ~ 1 acre. 3. Mr. Beal stated that the LCID has ceased to take in any land clearing debris (LCD) on site. Mr. Beal is no longer operating his grading company and stated he plans on closing the LCID in the near future. 4. Much of the material received has been covered with soil. 5. Continue to cover any remaining exposed LCD material with a minimum 18” of cover soil and stabilize with vegetative cover. 6. Per 15A NCAC 13B .0564(9)(a), “The facility shall meet the following buffer requirements: 50 feet from the waste boundary to all surface waters of the state as defined in G.S. 143-212. 7. LCID appears to have adequate buffers on all sides of LCD material. 8. No unauthorized wastes were observed in the LCID landfill during this inspection. 9. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 10. Working face of the landfill is covered. Some areas of exposed LCD material still to be covered on the sides of the landfill. 11. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 12. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. 13. Covered areas of the landfill are currently 3:1 and site should be able to achieve 3:1 final slopes upon completion without difficulty. 14. 15A NCAC 13B .0567 covers Closure and Post-Closure Care for LCID Landfills. A copy of this regulation will be attached with this report. 15. Ensure a ready supply of soil is available on site for cover material. 16. There was no indication of erosion or runoff. 17. Logs are removed from LCD and stored for firewood. 18. Open burning of solid waste is prohibited. 19. The facility has an all-weather access road. 20. The facility is secured by a steel cable and padlock. 21. The facility has a sign. 22. The entrance to the LCID landfill is on the right after mailbox 819, across from an abandoned blue house.
