Recorded in Warren County Register of Deeds: Book 0960 — Page 665. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time." At the time of this inspection, the side slopes were identified to be nearly vertical. The waste deposited at the top of the landfill had not been properly compacted. The side slopes need to be properly covered and graded to meet the three horizontal to one vertical requirement. 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. G.S. 130A-310.65." At the time of this inspection, the waste at the top of the landfill and along the side slopes had not been covered. The waste must be covered monthly or when the working face reaches one acre in size. Ensure that the waste is covered with no less than six inches of soil monthly or when the working face reaches one acre in size. Page 1 of 3 NORTH CAR()LINAD_E Q�� OepaNnent of Envieonmenbl Wel� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS A copy of the new LCID rules, which became effective on January 1, 2021, are provided with this report. Please read through the rules and contact me if you have any questions. Based on rule 15A NCAC 13B .0563 (6), within 5 years of the effective date, notified LCID landfills will need to be properly closed or obtain a permit from the Division of Waste Management. 1. The access road is of all-weather construction and appears to be properly maintained. 2. An attendant was onsite at the time of this inspection. 3. 15A NCAC 13B .0564 (6) (b), "Buffer Requirements: A site shall maintain the following buffer requirements: ... 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells." At the time of this inspection, it appeared that waste was encroaching on a sliver of PIN 3918423053, which is located to the east of Pearl Harbor Road. In order to meet the buffer requirements, you could either move the waste away from the property boundary or attempt to purchase the sliver of land from the owner to meet the 100-foot setback. 4. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Section .0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker." Edge of waste markers were not visible during this inspection. Permanent, clearly visible edge of waste markers must be established at the site, showing the under two -acre disposal boundary. 5. The waste stream observed appeared to be relatively clean. Several pieces of a plastic mesh material were observed. 6. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." A partial access road was identified during this inspection. The eastern side slope was overgrown with vegetation and could not be accessed via vehicle. 7. Digital pictures were taken during the inspection. 8. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed.
