Notification dated October 15, 2009. The Notification is recorded in Deed Book 2295, Page 738-740.
PURPOSE OF SITE VISIT:
Follow-up Compliance Inspection
STATUS OF PAST NOTED VIOLATIONS
15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working
face reaches one acre in size, whichever occurs first."
RESOLVED: The previously identified uncovered waste had been mostly covered. Several pieces of land clearing waste
were observed to be exposed. Ensure that the waste is covered with six inches of soil monthly or when the working face
reaches one acre in size.
15A NCAC 13B .0566 (1), "The facility shall only accept those solid wastes which it is permitted to receive."
RESOLVED: No unacceptable waste was observed during this inspection.
15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ration of three
horizontal to one vertical at any time."

PARTIALLY RESOLVED: The waste was determined to be properly sloped during this inspection. As identified in the
comments of the September 24, 2020, January 19, 2021, and April 21, 2021 inspection reports, the slopes of the of the mined area
in the western portion of the were identified to have vertical slopes. Ensure that the vertical slopes of the mined area are properly
sloped and seeded to prevent erosion.
OBSERVED VIOLATIONS
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
1. The facility is properly secured with a locked gate.
2. The access road is of all-weather construction and appears to be properly maintained.
3. Concrete debris was identified to be stored within the waste footprint, to the west of the entrance road. The amount
of the concrete debris stored within the waste footprint has not changed size between the September 21, 2020 and
April 21, 2021 inspections. Mr. Myrick stated in a telephone conversation on August 5, 2021, that the concrete is
broken up into rip -rap size and used by local clients on farm roads. This classifies as recycling of the concrete,
therefore, the concrete should be removed from the landfill and 75% must be processed, used and removed from
the property within the calendar year it was placed on the site, as stated in § 130A 309.05 (c)(1), "Seventy-five
percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of the
calendar year commencing January 1, shall be removed from the facility through sale, use or reuse by
December 31 of the same year."
4. 15A NCAC 13B .0201 (g), "disposal area boundaries for landfills permitted in accordance with Sections
.0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The
markers shall be of height and spacing so that they are distinguishable from the surrounding landscape,
and so that they adjacent markers are visible when standing at a marker." The eastern most marker was not
visible from the closest adjacent edge of waste markers. Additional markers may need to be installed or the
vegetation cleared so that the edge of waste boundary can be properly delineated. The waste deposited along the
upper edge of the mined area, appeared to be outside of the edge of waste markers. Ensure that the waste is within
the edge of waste boundary.
5. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for
access by emergency or fire -fighting vehicles and equipment." As of January 1, 2021, it is required that an access
road be established around the waste boundary for emergency access. Ensure that an access road is established around
the waste boundary.
6. A sign shall be posted at the site entrance showing the site contact's name and phone number, the permit number
(the site notification number should be used here), emergency contact information and the waste types accepted
for disposal at the site.
7. Remove any trees and deep root penetrating woody vegetation that may be growing over the waste.
8. Mr. Myrick stated during a telephone conversation on August 5, 2021, that he will likely only use the landfill occasionally
following this inspection. If Mr. Myrick wishes to no longer utilize the landfill, he will need to follow the closure
guidance in 15A NCAC 13B .0567.
9. Corrective measures necessary to bring this site into compliance should be completed by June 24, 2021.
