The driver was approached and when asked he indicated that the truck was owned by Bass Services and was in service to maintain portable toilets. At the time of the encounter the truck lettering did not meet the rule stated below. 15A NCAC 13B .0835 TRANSPORTATION OF SEPTAGE (b) All permitted septage management firms shall display lettering on each side of every pumper vehicle operated by the firm. The lettering shall include the firm name, town name, phone number, and septage management firm permit number as shown on the firm application. All lettering required by this Rule on the pumper vehicle shall be no less than three inches in height and legible, distinguishable from the background, and not obstructed from view. Identification shall not be removable (i.e. no magnetic signs). The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1) Lettering indicating firm name, town name, phone number and NCS permit number representing the current owner were not present (see violation page 1). 2) The septage holding tank was constructed of metal and appeared to be structurally sound. 3) The tank was bolted to the truck frame. 4) The septage drain valve appeared to be in working order. No septage leaks were observed. 5) All port covers and caps where in place and appeared to be in proper working order. The vehicle pictured above shall not be used for the transportation of septage until it is listed on the Bass Services 2020 Septage Management Firm Permit Application and has been verified to be in compliance with Septage rules by NCDWM staff. Corrective Action Requested: 1. Please provide an updated list of all vehicles used in the transportation of septage, including spare vehicles and tankers by Bass Services that provides: VIN number, license plate number and tank capacity of each vehicle. (Please see 15A NCAC 13B .0834 SEPTAGE MANAGEMENT FIRM PERMITS (c)(6)(7)(8)). 2. Please verify that all vehicles used in the transportation of septage, including spare vehicles and tankers by Bass Services meet 15A NCAC 13B .0835 TRANSPORTATION OF SEPTAGE as well as all other applicable Septage rules. Within 14 days of the receipt of this report please complete following requests and contact me to schedule a time to conduct a follow-up inspection of your facility.
