The Notification is described by the deed recorded in BOOK: 708 PAGE: 931. 6601-MSWLF-1982 landfill has closed. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS None. OBSERVED VIOLATIONS 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time." Waste appears to have been pushed into the tree line surrounding the clearing. The western side slope was identified to be nearly vertical. Several dead trees were identified along the western side slope. According to Mr. Lashley, the large stumps, trees, and soil piles were dumped at the site by NCDOT. Mr. Lashley stated that the County did not have large enough equipment to move the large stumps and trees. The waste needs to be moved away from the tree line and properly compacted, covered, and sloped. Coordinate the moving and covering of the waste with NCDOT. 'm"""°"""' Solid Waste Section 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first." During this inspection, there were two working faces identified along the western edge of the LCID. The waste identified at the working faces had been pushed into the tree line, appeared to have been at the site for quite some time and has not been covered. Ensure that the waste has been moved away from the tree line, covered, and properly sloped. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: A copy of the new LCID rules, which became effective on January 1, 2021, are provided with this report. Please read through the rules and contact me if you have any questions. Based on rule 15A NCAC 13B .0563 (6), within 5 years of the effective date, notified LCID landfills will need to be properly closed or obtain a permit from the Division of Waste Management. 1. The site has signage posted at the entrance of the facility. 2. The access road is of all-weather construction and appears to be properly maintained. N0093 LCID 3. Two large mounds of soil, which may be from ditch cleaning, were located in the western portion of the LCID area. During this inspection, Ms. Thompson observed a NCDOT Division 1 dump truck dump a load of dirt and yard trash. A damage plastic tote and other unacceptable plastic waste was observed throughout the facility. The unacceptable waste needs to be removed from the facility and properly disposed of at a licensed facility. 4. Mr. Lashley stated that the single truck load of brick and yard waste was from a residential customer. Mr. Lashley stated that he will push and cover the residential customer waste when he was able to. Mr. Lashley did not move any waste that was from NCDOT. A load of what appeared to be the remnants from an asphalt paving truck were also identified to have been dumped on the ground and not covered. Ensure that the waste is covered with six inches of soil monthly or when the area reaches one acre in size. 5. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Section .0500 or .1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent markers are visible when standing at a marker." Edge of waste markers were not observed at the facility. Permanent, clearly visible edge of waste markers must be established at the site, showing the under two -acre disposal boundary. 6. Several areas of standing water were observed near the working faces. The LCID should be graded to promote drainage away from the waste. 7. The overgrown vegetation at the LCID should be mowed to allow for proper inspection of the entire area. 6601-MSWLF-1982 8. A convenience site is located at the closed MSWLF and is used for tires, used pesticide containers, white goods and C&D waste. 9. Numerous electronic goods were being stored on the ground, outside of the maintenance building. Several of the televisions were lying face down on the gravel. Several pallets of electronic goods stored were within the maintenance building. Mr. Pernell stated that the electronic goods will be recycled once there are 22 pallets of goods. The electronic goods should be stored upright to prevent glass breakage and under cover to protect the recycling value. 10. White goods are stored upright on the concrete pad. Mr. Pernell stated that the County staff remove the CFCs from the white goods. Several pieces of metal recyclables were identified to be off the pad, behind the push wall. Ensure that all metal recyclables and white goods are stored on the concrete pad. 11. The shingle recycling area was clean. Good job! Mr. Pernell stated that the shingles had recently been picked up. 12. Approximately 25 mattresses were stored on the ground to the east of the concrete pad. The mattresses should not be stored directly on the ground and should be disposed of in a timely manner. 13. Open roll -off containers of C&D waste are located to the east of the concrete pad. Mr. Pernell stated that GFL Environmental picks up the containers of C&D waste as needed. Ensure that the C&D containers are removed from the facility in a timely manner, so that no leachate is generated and leaking from the containers. 14. The pesticide containers to be recycled are being stored within an enclosed trailer. 15. Tires are placed within an enclosed trailer. The tires should be laced together so that more tires may be place within the trailer. 16. A yard waste area was located to the east of a closed MSWLF trench. The yard waste was overgrown with vegetation. Mr. Pernell stated that the yard waste is not turned and left to degrade. The "compost" does not leave the facility unless a resident asks for it. The facility must complete a yard waste notification form if the facility wishes to compost yard waste. 17. Edge of waste markers were observed around the closed MSWLF and yard waste area. 18. The closed MSWLF was recently mown. Good job! 19. The monitoring wells were locked and properly labeled. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days' receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. Digital photographs were taken during the inspection.
