PURPOSE OF SITE VISIT: Complaint Inspection Follow Up STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0566 (7): UNRESOLVED- This rule has been readopted in 2021 and has changed is now combined into (3), (4), and (5). (3) All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet
unrestricted use standards for soils as defined in G.S. 130A-310.65. (4) Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community. (5) erosion control measures, structures, or devices shall be utilized to prevent silt from leaving the site and to prevent on-site erosion, and shall comply with 15A NCAC 04. Permit to operate Attachment 3, cover material requirements #21 states, “Within 120 calendar days after completion of the final disposal operations, the disposal area must be closed and covered with a minimum of one (1) foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. However, for ditches

located on the landfill, at least 2 feet of soil cover is required between the bottom elevation of the ditches and the waste mass.” 15A NCAC 13B 0.0564 (9): UNRESOLVED – This rule has been readopted in 2021 and is now (6) Buffer Requirements: A site shall maintain the following buffer requirements:(a) 50 feet from the waste boundary to waters of the State as defined in G.S. 143-212. (b) 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells. 15A NCAC 13B .0201 (a), (b), (c) - RESOLVED

ADDITIONAL COMMENTS
1. Purpose of this inspection was to follow up on a complaint and closure of this facility. The approximate 70 loads of soil/asphalt mix that were brought in have been removed by the owner Fred Smith Company, for recycle of asphalt and soil. Conversation via email with Deyna Ackerman, July 8, 2021 and Chris McClean, July 2, 2021, indicate they removed all the waste to one of their sites in Carthage. They also replaced soil to cover and regrade the area that was impacted by their waste on the 63C LCID. They also came back and put straw/seed on the area. Pictures were provided. Below are Mr. Powell’s photos.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

2. The permit for the Stump Hole LCID landfill expired in September of 2018. Allan Casavant, owner, decided to begin closure process at the landfill instead of applying for a permit renewal. There has been recent communication with Mr. Casavant about submitting the completed final paperwork for closure but it has yet to be submitted. Please do so ASAP once corrective actions have been addressed. 3. Be sure and continue to remove unapproved wastes, such as plastic, pipe and rubber mud flaps from dump truck and dispose at appropriate landfill. Equipment and vehicles are still being stored inside the Edge of Waste (EOW). Nothing should be on the landfill or inside EOW markers. EOW markers should
be fixed to meet rule. T-posts were visible and represented the EOW, according to Mr. Casavant. It should be determined if all these markers are EOW markers and in correct locations. Inspector will need to revisit for closure and verify the distance of buffers using these EOW markers.
Permit Condition No. 10, Part 1 of Attachment 3 of the Permit to Operated dated September 16, 2013 (DIN 18927) - The permanent markers that accurately delineate the waste disposal boundary must be maintained.

4. Remaining bare areas need vegetative ground cover, sufficient to restrain erosion, shall be established at this facility. Some vegetation needed mowing. Cut the trees/shrubs that are growing on side slopes. There are some along the road and some in front, along the side slope etc. Be sure and continue vegetation establishing efforts until successful. Some areas were recently seeded after soil was brought in and spread. Good job. Mr. Casavant stated a water truck will be brought in to irrigate the seeded areas.

5. Some uncovered vegetative waste was visible during inspection. Several logs, and a few chunks of large concrete/asphalt were needing cover or removal to appropriate landfill. Ensure those areas have the required depth of soil cover for closure.

6. Some potentially hazardous wastes are being stored just outside EOW. A couple pallets of motor oil in five gallon buckets were visible during inspection. Some were open with no lid or caps. Should these be dumped or spilled and contaminate the soil, then further compliance action and monitoring may be required for this site. Please remove to appropriate disposal location. Mr. Casavant on phone said he had plans to remove these
wastes.

7. Owner should communicate with the Sections Permit Engineer, Ming Chao, and with Moore County, to ensure all requirements that are needed for closure. Owner should communicate with Moore County Planning and Zoning for any permits or actions they may require. Also, DEMLR should be contacted, (910-433-3300 Tim LaBounty) in regards to any mining, sedimentation and erosion control and storm water requirements. 8. The Section has not received the require documentation to close the site. Once the property is sold, then new owner can apply for a permit at that time if they wish, but the site must be properly closed and in compliance per the rules before submitting a new application for permit. Please bring this site into compliance and submit required closure documentation. 9. Corrective measures are necessary to bring the landfill into compliance and should be completed within 30 day’s receipt of this inspection report. Confirm EOW markers/location and that site is compliant with buffer rules. Requested final closure documents need to be submitted to Section Permitting. Ensure proper cover and finish establishing grass cover. Cover or remove exposed wastes inside landfill. Equipment removed from landfill and inside EOW markers. Hazardous oil waste removed and disposed of properly. Remove shrubs/trees from landfill. Check with Moore County Solid Waste/Planning and Zoning on closure requirements. Check with DEMLR on closure requirements.
