Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 AREAS OF CONCERN AND COMMENTS: 1) “No Trespassing” signs were present along the two access paths leading to the detention tanks. 2) Inspected two – 4,000 gallon steel tanks. Each tank was cradled between two rows of railroad ties. Tanks appeared to be structurally sound. No leaks noticed. No septage has been stored in the tanks. 3) Tanks were accessible for inspection. Tanks were greater than five (5) feet apart from each other. An area greater than five (5) feet is being maintained around the tanks free of debris and vegetation to allow for the inspection of the tanks. 4) No issues with any of the required setback distances. Greater than 50 feet to the property line. 5) Permit issued on 09/11/18. 0BTwo – 4,000 gallon steel tanks.
