NOTICE OF VIOLATIONS:
1. 15A NCAC 13B .0566(16) states:
"A sign shall be posted at the facility entrance showing the contact name and number in case of an emergency."
Mr. Butler is in violation of 15A NCAC 13B .0566(5) in that he has failed to post a sign at the facility entrance
showing the emergency contact name and phone number.
To correct this violation and be in compliance with 15A NCAC 13B .0566(16), within seven (7) days from receipt of
this Notice, Mr. Butler must post a sign at the facility entrance showing the contact name and phone number in
case of an emergency.

2. 15A NCAC 13B .0566(4) states:
"Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs
first."
Mr. Butler is in violation of 15A NCAC 13B .0566(4) in that he has failed to apply adequate soil cover at least monthly,
or when the waste disposal area reaches one acre in size, whichever occurs first.
To correct this violation and be in compliance with 15A NCAC 13B .0566(4), within fourteen (14) days from receipt
of this Notice, Mr. Butler must apply adequate soil cover at least monthly, or when the waste disposal area
reaches one acre in size, whichever occurs first.
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be
assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be
subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a
solid waste collection service and any such further relief as may be necessary to achieve compliance with the North
Carolina Solid Waste Management Act and Rules.

AREAS OF CONCERN AND COMMENTS:
1. Site is active and is located on PIN # 0659-85-6103.
2. Property boundaries and waste area boundaries are not clearly marked. Review of McDowell County GIS
suggests the waste area may be less than 100-ft. from the property lines to the south. Please ensure that
the required buffer of 100-ft from all disposal areas and all property lines is maintained.
3. The required signage with an emergency contact name and phone number is not present.
4. Unacceptable wastes (e.g. wire, carpet, plastic pipe, etc.) have been removed and segregated from the waste
stream for proper disposal.
