The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS: 01 – This site only receives concrete for grinding. 75% is ground and used annually. Facility owns grinder. 02 – Metal is removed from concrete.
03 – Need to upgrade signage with facility number (N0066). 04 – Facility has locking cable. 05 – Site is kept in good condition. 06 – Site is not open to the public. 07 – Add Edge of Waste Markers to define landfill area.
08 – Due to the New LCID 2021 Rules (Attached pdf’s), notified LCID facilities must meet these rules and apply for a Permit within 5 years (2026) or close the facility by the LCID closure requirements. Or, follow the (attached)
130A-294 (a) 4 (a) Law. § 130A-294. Solid waste management program. (a) The Department is authorized and directed to engage in research, conduct investigations
and surveys, make inspections and establish a statewide solid waste management program. In establishing a program, the Department shall have authority to:
(4) a. Develop a permit system governing the establishment and operation of solid waste management facilities. A landfill with a disposal area of 1/2 acre
or less for the on-site disposal of land clearing and inert debris is exempt from the permit requirement of this section and shall be governed by G.S. 130A-
301.1. Demolition debris from the decommissioning of manufacturing buildings, including electric generating stations, that is disposed of on the
same site as the decommissioned buildings, is exempt from the permit requirement of this section and rules adopted pursuant to this section and shall
be governed by G.S. 130A-301.3. The Department shall not approve an application for a new permit for a sanitary landfill, excluding demolition
landfills as defined in the rules of the Commission, except as provided in subdivisions (3) and (4) of subsection (b1) of this section. No permit shall be
granted for a solid waste management facility having discharges that are point sources until the Department has referred the complete plans and specifications to the Commission and has received advice in writing that the plans and specifications are approved in accordance with the provisions of G.S. 143-215.1. In any case where the Department denies a permit for a solid
waste management facility, it shall state in writing the reason for denial and shall also state its estimate of the changes in the applicant's proposed activities
or plans that will be required for the applicant to obtain a permit.
09 – Facility was sent an email outlining some of these rules and discussed during this inspection. 10 – Facility road is constructed of all-weather materials (gravel). 11 – Overall management of this facility is good.
