STATUS OF PERMIT:
The Large Type 3 Permit was issued on February 14, 2019. The permit will expire on February 14, 2024.
Wind River Environmental is identified as the operator in the permit.
PURPOSE OF SITE VISIT:
Complaint Inspection
STATUS OF PAST NOTED VIOLATIONS
A. 15A NCAC 13B .1406 (3), "Stormwater shall be diverted from the operations area."
And Permit to Operate, Attachment 3 (18), "An appropriate Division of Energy, Mineral and Land
Resources (DEMLR) permit for managing any stormwater and/or wastewater at the facility must be
maintained as required. Any leachate generated at the facility and any runoff from the facility must be
managed to prevent contamination of groundwater and surface water. The facility must be maintained to
prevent the accumulation of stormwater and leachate on composting areas, storage areas, and roads."
UNRESOLVED: At the time of this inspection, the windrows were identified to be running north -south,
perpendicular to the drainage slope, which runs from east to west. The area had received a large amount of rain
the week prior from Tropical Storm Elsa. Due to the windrows running perpendicular to the drainage slope,
surface water is trapped by each windrow and drained to the next. Dark leachate was found to be running between
windrows and ultimately to the drainage feature in the northwestern corner of the facility. A large area of standing

water was observed near the southern end of the eastern most windrow. It is recommended that the windrows be
reconfigured to run from east to west, so that any surface water is shed and not impounded within the windrows.
The area should be graded to remove any ruts or low-lying areas and promote drainage away from the windrows.
B. Permit to Operate, Attachment 3 (10), "All sides of storage and compost areas for flammable materials
must be clear and drivable, to provide vehicular access in the event of a fire."
RESOLVED: During the inspection, the windrows were accessible on all sides.
ADDITIONAL OSERVED VIOLATIONS
A. 15A NCAC 13B .1406 (4), "Leachate shall be contained on site or treated prior to discharge. A National
Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC
02B prior to the discharge of leachate to surface waters."
Black organic leachate was observed to be flowing from the northern end of the compost windrows. The leachate
was following the natural drainage to the west towards a drainage feature in the northwestern corner of the facility.
Stressed vegetation was observed within the path of the organic leachate adjacent to the drainage ditch. Leachate
was also found to be pooling at the culvert that goes underneath the haul road. The flow of leachate off site should
be stopped immediately.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
1. This facility is a Large Type III Solid Waste Compost facility.
2. The facility is permitted to accept dewatered septage and grease, food waste, manure, yard waste, vegetative
material, and clean wood material.
3. Signage has been posted at the entrance to the facility listing the permit number, and emergency contact number
as well as materials accepted at the facility. The facility is not open to the public.
4. The site is secured by a locking gate at the facility entrance.
5. The facility access road is of all-weather construction and is well maintained at this time.
6. Access around the facility is stable, and no areas of erosion were noted during this compliance inspection.
7. A piece of cinder block was identified in the western most windrow. The unacceptable waste within the windrows
has been kept to a minimum. Continue to remove any unacceptable waste identified within the windrows.
8. No fugitive dust was observed during the facility compliance inspection.
9. Odors were minimal in the composting area, and none were noted at the permitted facility boundaries.
10. No windblown debris was observed during this facility compliance inspection.
11. Immediately stop the flow of leachate from this site and all other corrective measures required as a result
of this inspection and should be completed within 30 days' receipt of this inspection.
