administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on July 14, 2021.
2. The facility is open to the public Monday through Saturday 7:00 am to 4:00 pm.
3. Waste is hauled by Atomic Transport to the Upstate Regional Landfill in Enoree, South Carolina for disposal.
4. A permit exempt Type 3 compost operation is located at the facility. Per 15A NCAC 13B.1402(g)(2), a permit
exempt compost operation receiving Type 3 waste is restricted to an operational area less than one -acre total
and no more than 100 cubic yards of unfinished material onsite at any time.
Records Review
5. The life -of -site permit and approved operations plan for the transfer station were available for review. However,
it was noted that the permit for the HHW facility had expired on April 12, 2021. A follow up phone call was
made to Permit Engineer Allen Gaither to ensure that county staff had been in contact with him to begin the
renewal process.
6. Tonnage records were provided for review for the 2020-21 fiscal year. The facility disposed of 118,096.57 tons
of waste from July 1, 2020 to June 30, 2021.
7. Waste screenings from February 1, 2021 to July 10, 2021 were available for review. The facility conducts six
waste screenings per day, Monday through Friday, and three on Saturday. The forms showed the final
disposition of any unacceptable waste that was encountered; however, the forms did not have the weight of the
loads recorded. 15A NCAC 13B .0405(8)(A) which became effective January 1, 2021 states in part: "Site
personnel shall screen incoming loads weekly at a rate of no less than five percent of the average daily
waste tonnage reported in the site's annual report for the previous year ... Waste screening and rejected
wastes shall be recorded in writing, and the records shall be kept on site for no less than five years and
shall be made available to the Division during a site inspection or upon request."
Please ensure that weights are recorded on the waste screening forms to ensure the five percent of the average
daily tonnage rate is being achieved.

Operations Inspection of the Transfer Station (4504T-TRANSFER-1998)
10. The transfer station consists of two pre-engineered buildings. Commercial trucks and vehicles with hydraulic lifts
unload in Shed 1 and residential customers and hand unloaders use Shed 2.
11. The tipping floor and push walls were in good condition in both sheds.
12. The trench drains in both buildings were clear and appeared to be working properly at the time of inspection.
13. Five loaded trailers were parked in the loaded trailer parking area located to the southwest of the transfer
building. Any leachate that is lost from parked trailers is collected by a drainage system that is connected to the
Cane Creek Sewer System. All transfer trailers on site were in good condition and appeared to be leak resistant.
14. Loading tunnel 2 was clean and a small amount of material from trailer loading was observed in tunnel 1.
Leachate drains in both tunnels were clean and appeared to be working properly.
15. Windblown litter was minimal and well managed at the time of inspection.

Operations Inspection of Area 4 (Scrap Tire and Electronic Waste Collection)
16. Four trailers were staged in Area 4 to receive scrap tires and no scrap tires were stored outside the trailers.
17. Electronics are collected, sorted and palletized, and sent to ECycle Secure in Charlotte, North Carolina for
recycling.
Operations Inspection of Area 5 (Treatment and Processing)
18. The wood waste treatment and processing operation is permitted to receive land clearing waste and
untreated/unpainted pallets. Pallets and land clearing waste are collected in separate stockpiles.
19. No unapproved material was observed in either of the stockpiles at the time of inspection.
20. Adequate access was provided around the stockpiles for firefighting equipment if it was needed.
Operations Inspection of the Household Hazardous Waste Unit
20. Household hazardous waste is collected at the Citizen's Convenience Center located to the northeast of the
transfer station. The convenience center collects recyclables, white goods, waste oil, antifreeze, batteries, used
electronics, household hazardous waste and mercury products recycling. TV's and monitors are accepted with
payment at the transfer station.
21. The permanent household hazardous waste collection unit is permitted to receive household hazardous waste
(HHW) generated by residents of Henderson County. The facility may not collect radioactive waste,
explosives, or infectious wastes. The HHW only operates on specific collection dates specified by the county.
22. The facility separates oxidizers, flammables, and pesticides and utilizes a lockable three compartment steel
hazardous waste cabinet with under floor secondary containment for storage of the collected materials. All
drums in the cabinet were observed to be labeled.
23. Used cooking oil, motor oil, antifreeze and used oil filters are collected undercover and the collection tanks
have secondary containment. The collected motor oil, antifreeze and filters are sent to Enterprise Oil in
Knoxville, TN for recycling and the used cooking oil is sent to Blue Ridge Biofuels for processing.
24. The facility collects white goods and scrap metal for recycling. White goods containing refrigerants were
observed to be stored upright. The collected scrap metal is sent to CMC Recycling in Spartanburg, SC.
