AUDIT PARTICIPANTS: Bill Wagner, NCDENR STATUS OF PERMIT: Notified Land Clearing and Inert Debris Site – Site is Active. PURPOSE OF AUDIT: Initial inspection for current inspector. NOTICE OF VIOLATION(S) (citation and explanation): 15A North Carolina Administrative Code 13B .0564(9)(a) states that Land Clearing and Inert Debris (LCID) landfills shall meet a minimum buffer requirement of 100-feet from the disposal area to property lines. During an on-site inspection performed on June 25, 2009, Bill Wagner, using laser range finding binoculars, determined that the disposal area is approximately 60-feet from Abington Road. This is a violation of 15A N.C.A.C 13B .0564(9)(a). To achieve compliance, all LCID wastes that are less than 100-feet from property lines, residential dwellings, commercial or public buildings and wells must be removed. Immediately begin the removal, relocation and or proper disposal of all wastes that are currently located less than 100-feet from property lines, residential dwellings, commercial FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 2 of 3 or public buildings, and or wells. Within 30 days from the aforementioned notification, all wastes must be removed from within the buffer areas as required by 15A N.C.A.C 13B .0564(9)(a). You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. STATUS OF PAST NOTED VIOLATIONS (List all noted last audit): None. AREAS OF CONCERN AND COMMENTS: 1. The site is active. 2. There was no one on site. 3. No prohibited wastes were observed. 4. The site is stable. 5. The limits of the waste are not at least 100-ft. from all property lines and all buildings as required. 6. As the property line on the east of the land parcel is not marked, it is not possible to determine if there is a 100- ft. buffer between waste disposal and eastern property line. 7.
