RESOLVED: 15A NCAC 13B .0405(d) states, in part, "The owner or operator of a site shall retain an operating record in electronic or hard copy format at the site, or in an alternative location stated in the permit. All required records were available for review at the scale house at the time of this inspection. Therefore, this violation is considered to be resolved. Page 1 of 5 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section 2. RESOLVED: 15A NCAC 13B .0563(1) states, "The site shall only accept yard waste and inert debris waste for disposal. " No unacceptable wastes were found during the inspection of the LCID landfill and the yard waste and inert debris collection areas. Therefore, this violation is considered to be resolved. 3. RESOLVED: 15A NCAC 13B .0566(3) states, `All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. " All waste in the LCID landfill, with the exception of the current working face, was observed to have been covered with at least 6" of soil. Mr. Cain provided an operating log in which he had indicated the date the landfill was covered, and information about the new lift that had been started after cover had been completed. Therefore, this violation is considered to be resolved. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The purpose of this inspection was to follow up on the status of the observed violations and other concerns cited in the report covering the previous inspection on May 11, 2021. 2. All photos were taken by Susan Heim on July 13, 2021, during this inspection. 3. Mr. Earp had records available documenting the monthly pressure washing of the tipping floor, loading bay and push walls that he performs himself, as well as the required semi-annual pressure washing of the entire transfer station building that is performed by a contractor of Republic Services. Mr. Earp stated that he would coordinate with Republic Services staff to ensure that the thorough cleaning of the transfer station building takes place at least every 6 months, as required. 4. At the scale house, Mr. Cain was able to show that all required records are now being maintained onsite as required. Please ensure that a copy of this inspection report, along with previous and future inspection reports, is added to the facility operating record and maintained at the scale house. (See Observed Violations section of this report for additional information) 5. Copies of the report covering the September 2020 groundwater monitoring event were distributed to the Solid Waste Section and to Yadkin County on May 24, 2021, by Jonathan Pfohl, Municipal Engineering Services. Please ensure that copies of the groundwater monitoring report for the March 23, 2021 event are provided to the Solid Waste Section within 120 days of the sampling event, as required by 15A NCAC 13B .1632(i). A copy of all groundwater and landfill gas monitoring reports must also be maintained at the scale house either in digital or paper form and made available for review upon request. (See Observed Violations section of this report for additional information.) 6. Mr. Cain stated that he had attended Transfer Station Operations Specialist training and had become certified through NCSWANA, as previously recommended. 7. The entire facility was observed to be clean and well -maintained. Windblown litter was minimal across the entire site. 8. The previous scrap metal collection area was inspected to ensure that clean-up had been completed. The site was observed to be free from scrap metal and waste and had been leveled so that it could be used as an operations area for the LCID landfill. 9. All painted concrete had been removed from the inert debris stockpile and properly disposed of at the transfer station. (See Observed Violations section of this report for additional information.) 10. The entire area of the LCID landfill had been completely covered since the previous inspection. No unacceptable material was observed in the LCID landfill. (See Observed Violations section of this report for additional information) 11. In response to questions about the condition of the scales, Mr. Cain stated that another damaging thunderstorm had taken place, and several cells had been replaced as a result. He added that he had no additional information about the county's plans to replace and relocate the scales and the scale house. Please work with Jordan Russ, Permit Engineer, to address permitting requirements relating to these plans prior to proceeding with purchasing or installing new equipment or beginning any construction at the site. The residential convenience area, electronics collection pad, scrap metal collection area, loading docks where scrap tires and cardboard are collected were all found to be clean and well -maintained. All scrap metal had been removed from the concrete bunkers and stored in roll -off containers awaiting pick-up by the county's scrap metal contractor, Triad Metal Recyclers. Several white goods were staged in the first bunker on the concrete pad. Units containing refrigerants were stored upright to maintain the integrity of the refrigeration systems to prevent gas leaks. No unacceptable material was observed on the concrete pad in the scrap metal collection area. A view of the LCID landfill from the operations area.
