STATUS OF PAST NOTED VIOLATIONS:
.0838(j) Septage shall be transferred to and from a detention system in a manner that prevents leaks or spills of
septage onto the ground surface or exterior surface of the detention system, including septage in pipes used for
transferring waste to and from vehicles. Although there were no recent spills during this visit there is evidence
that overflow spills of septage are occurring on a semi regular basis from the two permitted septage detention
tanks #101 & #102. Although any septage spill is contained within the concrete containment area this does not
authorize LES to allow the storage tanks to overflow during normal operation. Corrective actions shall be taken
by LES to install alarms or other adequate measures & procedural changes to prevent any overflow spills from
occurring.

ADDITIONAL COMMENTS
1. The two permitted septage tanks (#101 & #102) appear structurally sound and are located with a concrete
containment area. The approved setbacks are being met. The required “No Trespassing” sign is posted at the
gate entrance and the access road is adequate. The required 5 foot cleared radius (free of excess vegetation or
debris) is present around the facility.
2. Discussed the permit renewal underway at this time. Reviewed the treatment logs & the required information to
be maintained – discussed missing info & gave Mr. Mayberry an example treatment log which he
indicated would be used going forward to ensure that the required info was recorded accurately.

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
