PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. In accordance with 15A NCAC 13B .1402 (g)(1), "The owner or operation of any Type 1 Solid Waste (yard waste) facility which occupies less than two acres of land and be limited to no more than 6,000 cubic yards material onsite at any one time, including finished product, shall submit a Yard Waste Notification form to the Department by June 15t of each year. The Yard Waste Notification shall be completed and submitted as required immediately so that the yard waste facility will be in compliance or remove all of the waste and submit notification of intent to close this site. Please notify Section staff once the documents have been submitted as required. 2. The access road to the facility is being managed properly at this time. 3. Permanent, clearly visible edge of waste markers must be established at the site, showing the less than two - acre operation area. Ensure that all materials are within the operation area and that the 50-foot buffer from property lines and perennial streams are being maintained as required by rule. 4. 15A NCAC 13B .1406 (6), "A site shall only accept those solid wastes that it is permitted to receive." During this inspection, several black trash bags were observed adjacent to a pile of tree limbs and brush. The non- conforming waste needs to be removed from the facility and properly disposed of. 5. Tree limbs and branches are chipped on -site. Leaf material is ground by the leaf pickup machine. The chipped debris and ground leaves are stored in separate windrows. Semi-annually the chipped debris and ground leaves are comingled and used as mulch. This waste stream must be monitored and managed in accordance with 15A NCAC 13B .1406 (10)(b) and (11), ensure that temperatures are meeting the requirements and recorded to show that the ground yard waste meets the pathogen reduction criteria before using off site. 6. The entire site should be mowed to allow for the proper inspection of the operational area. 7. Low areas were identified adjacent to the windrows. These low spots may hold water after storm events. The area should be graded so that water is shed away from the windrows. 8. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. 9. Digital photographs were taken during the inspection.
