The Notification is recorded in Deed Book 2295, Page 738-740. PURPOSE OF SITE VISIT: Follow-up Compliance Inspection STATUS OF PAST NOTED VIOLATIONS Unknown status of the following Violations. The gate was locked and a follow-up inspection could not be performed. 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first." UNRESOLVED: The waste in the eastern portion of the LCID has not been covered with the minimum of six inches of soil. At the time of this inspection, waste was now being placed along the upper edge and in the western portion of the mined area. The waste in the western portion of the mined area will need to be compacted and covered with six inches of soil monthly or when the working face reaches one acre in size. UNRESOLVED: At the time of this inspection, non -conforming wastes, such as asphalt shingles and painted block, were observed within the eastern portion of the LCID. Painted block may only be accepted, if analytical data determines that there is no lead within the paint. Any non -conforming waste MUST be removed and properly disposed of. OBSERVED VIOLATIONS 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ration of three horizontal to one vertical at any time." As identified in the comments of the September 24, 2020 and January 19, 2021 inspection reports, the slopes of the of the mined area in the western portion of the were identified to have vertical slopes. Waste was identified placed along the upper edge of and within the mined area has not been compacted or properly sloped to a 3:1 ratio. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The gate to the facility was locked. The Section was unable to perform a follow-up inspection. 2. Mr. Myrick did not sign the green card for the April 21, 2021 Inspection Report and the May 24, 2021 Notice of Violation letter. A copy of the Inspection Report and Notice of Violation were hand delivered to the Halifax County Sheriff Department on June 30, 2021, so that a Deputy could deliver the paperwork to Mr. Myrick.
