STATUS OF PERMIT: Notified LCID – Preparing for closure PURPOSE OF SITE VISIT: Comprehensive Inspection Follow up STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Andrew Hammonds and David Powell inspecting to follow up on facility issues and preparing for closure. Waste no longer being accepted at this NLCID. 2. Remove all unacceptable waste before soil cover is applied. 3. 50 Ft. expansion area needed cover. Be sure and get proper cover on all waste within 30 days of receipt of the waste. There was a small pile of waste atop on west end as well. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 4. Edge of Waste Markers (EOW) were visible on the corners of the NLCIDLF but one still needs to be added near concrete. This will help staff see both limitations when inspecting onsite. Suggest keeping tall white PVC pipe. 5. Concrete crushing and removal is still needed. Section staff explained 75% rule (§ 130A-309.05. Regulated wastes; certain exclusions) and the need for material to be removed otherwise it becomes disposal in previous inspection. 6. Fix the access around the west side. This was mentioned before in last inspection. Concrete is in the way and needs crushing. Roads should be of all-weather construction and maintained. Concrete separation and equipment driving around side of the NLCID LF has made it difficult to get to backside of NLCID if need be with vehicles. 7. Ensure that during all development, operation and closure activities, side slopes do not exceed 3:1 (15A NCAC 13B .0565 (K)). Some slopes were a little steep, and needed correcting. Erosion rills were visible around side slopes. Address cover, sloping and vegetating to meet new closure rules. NLCID Closure and Post Closure Care rules (15A NCAC 13B .0567) were sent via email to Duncan Parker on 4/23/2021. A copy of all the new LCIDLF rules were sent again via email on 6/14/2021. Once sides are sloped and all exposed waste is covered properly, to closure rule depths, please establish good perennial grasses for vegetation. This will provide long term erosion control. Shrubs and trees should not be allowed on the structure and there are post closure care requirements, such as frequent mowing, that will be needed to maintain the structure. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 5 9. 15A NCAC 13B .0567 (2) - The owner or operator of a site shall complete the closure activities within 120 days after beginning the closure activities as specified in Subparagraph (1) of this Paragraph. (3) Within 30 days of completion of closure of the site, the owner or operator shall submit to the Division a certification verifying that closure has been completed in accordance with this Rule. If required by G.S. 89C, the certification shall be completed by a licensed professional engineer. 10. Corrective measures are necessary as a result of this inspection. These actions should be complete within 30 days’ receipt of this inspection report. Since this facility has accepted its last receipt of waste and begun closure, it now has 120 days to complete closure activities. Inspection date of June 14, 2021 can be used as the start of the 120-day time limit.
