NOTED VIOLATIONS:
A. 15A NCAC 13B .0405 (b), "Water that comes into contact with solid waste is leachate and shall be collected
from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer
line."
Permit to Operate, Attachment 1, Part VI (17), "All water or liquid that comes in contact with solid waste,
including vehicle wash -down water is leachate and must be captured and properly treated before release into
the environment."
During this inspection, an area of leachate-stained soils was observed to the east of the transfer trailer bay outside
of the containment area. At the end of the inspection, Mr. Deming was informed that the soils would need to be
removed and that he would need to contact their engineer to facilitate the sampling and analyzing of soil samples.
On June 24, 2021, Mr. Deming contacted Ms. Thompson and stated that the soils would be excavated and that their
engineer, Smith+Gardner would prepare a sampling plan. Smith+Gardner provided a sampling plan to the Section
on June 25, 2021. Mr. Deming also stated that he would have a curb installed along the edge of the concrete to

prevent the leachate from leaving the leachate collection system.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The Life of Site Permit was issued June 28, 2017. Facility is required to submit an annual facility report on or before
August 1 annually.
2. 15A NCAC 13B .0405 (11), "Unless otherwise stated in the site permit, all waste shall be removed from the
tipping floor, the truck loading bays, and from behind the push walls by the end of each day of operation and
disposed of in accordance with this Subchapter." Numerous cardboard boxes and miscellaneous pieces of waste
were observed within the transfer trailer loading bays. The waste within the transfer trailer loading bays needs to
be picked up and disposed of in the appropriate containers by the end of each day. A large pile of cardboard boxes,
mixed with miscellaneous trash, was observed within the recycling area. The bottom layer of cardboard boxes
appeared to have been wet from the leachate on the tipping floor. Mr. Deming provided photographs of the cleaned
recycling area and recycling transfer trailer day on June 24, 2021.
3. 15A NCAC 13B .0208 (4) (H), "The following items shall not be accepted at collection centers for the purposes
of disposal: liquid waste, unless it is in containers similar in size to containers found in household waste."
During this inspection, an unknown sludge type waste was observed on the tipping floor and partially blocking the
sidewall leachate drain. The equipment operator stated that he did not know who delivered the waste, as it was on
the tipping floor prior to him arriving at the transfer station. The tipping floor was coated with waste and in need of
power washing. It is possible that the sludge that was dumped in the transfer station for disposal contributed to these
conditions. On June 25, 2021, Mr. Deming determined that the sludge came from a water reclamation plant adjacent
to Reser's Fine Foods in Halifax. Mr. Deming stated to the Section that he was working with the water reclamation
plant to find another route of disposal of the sludge and that it would no longer be accepted at the transfer station.
4. Several areas of the southern exterior wall were determined to be bowed and damaged. Mr. Deming provided
correspondence with a contractor who would be completing repairs to the push walls and exterior walls of the
facility.
5. Joan Smythe, Smith + Gardner, has contacted Christine Ritter concerning the sampling plan.
6. Corrective measures are necessary as a result of this inspection and should be completed within 30 days'
receipt of this report.
