The Notification was filed for recordation with the Wilkes County Register of Deeds on August 16, 2016. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 15A North Carolina Administrative Code 13B .0566(1) states: “The site shall only accept those solid wastes that it is permitted to receive.” During the inspection, multiple pieces of painted wood were observed on the north side of the disposal area. Therefore, Louisiana-Pacific is in violation of 15A NCAC 13B .0566(1). Gerstell) To achieve compliance, within 30-days of issuance of this inspection report, all unacceptable wastes must be removed and properly disposed at a solid waste management facility permitted by the Division of Waste Management. Proof of disposal must be provided by submitting all solid waste management facility receipts where waste is disposed to the Solid Waste Section. Receipts for disposal should be mailed to: Charles Gerstell NCDEQ – Solid Waste Section 610 East Center Avenue, Suite 301 Mooresville, North Carolina 28115 ADDITIONAL COMMENTS 1. The facility is located on a 405.2-acre parcel of land located on ABTCO Road and is owned by Louisiana-Pacific Corporation. 2. Access to the is secured by a gate and access must be granted via scale house personnel. A secondary gate consisting of electrified wire is located at the direct entrance of the landfill area. 3. The waste area appeared to be less than 2-acres at the time of inspection. 4. Waste within the landfill consisted primarily of soil and wood chips. A small amount of broken concrete and asphalt was observed along the southern edge of the disposal area. 5. No erosion or off-site sedimentation was observed. However, erosion and sedimentation control measures should be provided along the southern perimeter of the disposal area. 6. It appeared that all required setbacks were being maintained. 7. The entire disposal area must be marked with permanent markers. During the inspection, a steel stake was observed near the southern extent of the landfill area, and one was observed at the northern extent. However, it did not appear that the entire footprint of the disposal area was clearly marked around the entire perimeter of the disposal area. 8. No standing water was observed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All access roads were of all-weather construction and well maintained. 10. 15A North Carolina Administrative Code 13B .0563 states in part: “The owner or operator of a land clearing and inert debris landfill (site) shall obtain a permit from the Division.” x 15A North Carolina Administrative Code 13B .0563(6) states: “Within five years of the readopted effective date of this Rule, the owner or operator of a notified LCIDLF that was not closed prior to the readopted effective date of this Rule shall comply with the requirements of this Rule, or shall close the notified LCIDLF in accordance with Rule .0567(b) of this Section, except that the required notification of closure is not required to be certified. For the purpose of this Rule, "notified LCIDLF" means a site that was not required to obtain a permit from the Division prior to the readopted effective date of this Rule because the site was designed and constructed to be two acres or less in size, and was required to record a notification for the site with the Register of Deeds' office and submit the notification to the Division.” x The land clearing and inert debris landfill rules were readopted effective January 1, 2021. Therefore, this site must be closed or obtain a permit before January 1, 2026. Please contact the Permitting Branch for permitting requirements.
