Permit to Operate renewed January 30, 2019. Permit to Operate expires June 28, 2023. PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: None. Long.:-80.181527' OBSERVED VIOLATIONS: 1. RESOLVED: 15A NCAC 13B .0203(d) states, `By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit." Permit No. 2909-LCID-2013, Part VII: Miscellaneous Solid Waste Management, Condition 2 states, "Recyclable or recovered materials may be received and processed as described in the approved plan (FID 1260730). The received unprocessed materials and final products shall be placed at the designated locations as shown on the drawing Sheet No. C2.0 (FID 1260730)." Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section All unprocessed wood waste had been moved to the designated storage area in the northern corner of the site. All scrap metal had been collected and removed by the facility's contracted metal recycler. No wood waste was found in the inert debris stockpiles or in the berm that runs along the northeastern side of the property parallel to the public roadway. Therefore, this violation is considered to be resolved. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The facility is a land clearing and inert debris (LCID) landfill. Permitted operations include the treatment and processing of used concrete and clean wood waste. The permit renewal issued January 30, 2019 includes a 5.56- acre expansion of the landfill disposal area. A written construction certification and as -built survey drawings for the expansion area must be provided to and approved by the Solid Waste Section before any waste may be placed in this 5.56 acres. All photos included in this report were taken by Susan Heim on June 25, 2021 during the inspection. 3. Facility records were reviewed with Mr. Veach, who stated that he had not been able to locate all of the required documents. A link to the current facility permit will be provided to Mr. Veach following this inspection. Mr. Phillips stated that he would email a digital copy of the site plan drawings to Mr. Veach. Mr. Veach stated that he would print out these documents and see that they are maintained at the facility, along with the cover log and approved erosion control plan, as required. 4. Mr. Veach stated that a new facility sign was being made and would be posted on the gate, thus eliminating the problem of weeds obscuring the sign that is currently posted in the road right-of-way. 5. Permanent edge -of -waste markers were observed around the entire perimeter of the permitted disposal boundary. However, the limits of the original landfill area had not been marked. It is recommended that the edge of the original 3.32-acre landfill cell be marked so that operations do not accidently spill over into the new 5.56-acre expansion area prior to approval by the Solid Waste Section. 6. Mr. Phillips verified that operations were still confined to the originally approved 3.32-acre landfill footprint. Prior to moving into the 5.56-acre expansion area, please provide the engineer's construction certification and as -built drawings, and arrange for a pre -operations inspection of the facility by the Solid Waste Section, as required by the permit to construct Pre -Operational Condition #5 — items a through h. 7. The current landfill side slopes had been reshaped and compacted since the previous inspection on May 25, 2021. Slopes appeared to be stable and were observed to have a gentle grade well below the maximum 3:1 allowed by the facility permit. 8. Several equipment operators were observed to be working on the landfill during the inspection. Clean soil cover had been applied to the entire landfill since the previous inspection. The working face was small, and waste appeared to be well compacted. No unacceptable waste was observed in the working face. 9. The tipping area was large enough to ensure adequate room for incoming vehicles and landfill equipment to maneuver safely in the space. 10. The sediment basin and the ditch line leading to it had been cleared of sediment, and new baffles had been installed in the basin. Mr. Houck recommended that the area surrounding the basin be seeded to reduce the flow of sediment to the ditch line and basin. Mr. Houck also reviewed monitoring and recordkeeping requirements relating to the site's erosion control plan. 11. Scrap metal had been collected from all areas of the site and removed by the facility's metal recycling contractor. Mr. Phillips stated that a new roll -off container for the collection and storage of scrap metal would be staged in the concrete crushing area by the contractor. 12.
