STATUS OF PERMIT:
The Original Yard Waste Notification was submitted to the Section on November 11, 2020. Renewal YWN submitted on
May 26, 2021.
PURPOSE OF SITE VISIT:
Follow-up to January 19, 2021 inspection and provide technical assistance for violations received.
NOTICE OF VIOLATIONS
A. 15A NCAC 13B .1402 (e)(6)(A), "Small Type 1 Facilities shall have an operations area less than two acres in
size and shall be limited to no more than 6,000 cubic yards material onsite at any given time, including
finished product."
UNRESOLVED/SOME PROGRESS MADE: During the inspection, the stockpile of land clearing debris which
was previously located to the south of the residence, has been moved to the western portion of the facility, near the
barn. Roy stated that the area in the western portion of the facility, was where he was planning on having the 2-acre
YWN. Roy stated that he was working on reducing the size of the operation area to under the 2-acre size limit. The
2-acre operation area needs to be surveyed and boundary markers installed, to ensure that buffers are met
and the operation area is under the 2-acre size limit. Ensure that the stockpiled land clearing debris is
properly windrowed so that the amount of debris can be determined. Ensure that all buffers are met when
surveying the operational area.
B. 15A NCAC 13B .1406 (7)(a), "Open burning of solid waste shall be prohibited."

RESOLVED: During this inspection, no open burning was observed at the facility.
OBSERVED VIOLATIONS:
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The stockpiles of mulch located in the southeastern corner of the Site have been properly windrowed and moved away
from the tree line in order to provide a fire lane around the mulch stockpiles. Work should continue to remove or
reduce these piles.
2. A stockpile of soil with some roots was identified to be adjacent to the land clearing stockpile. Roy stated that the soil
was soil that was brough into the facility with the land clearing debris. The soil will reportedly be screened to remove
the roots and then sold as topsoil. The soil stockpile needs to be removed from the operation area in order to
provide adequate space to windrow the land clearing debris.
3. Several piles of ground and dyed mulch were located just outside of the proposed operation area. The finished mulch
should be placed in the bins near the office for sale. All waste and finished material counts toward the 6,000 cubic
yards.
4. Most of the plastic and metal debris, as well as the identified tires, have been removed from the concrete and brick
debris area located to the east of the pond. Several pieces of plastic were still observed within the debris. The plastic
debris will need to be removed from the concrete and brick waste area. The brick and concrete debris were
identified to have been pushed into the adjacent tree line and natural drainage feature during the January 19, 2021
inspection. The concrete and brick debris has not been moved away from the tree line or drainage feature. The
concrete and brick debris must be moved away from the tree line and drainage feature, properly sloped to a
three horizontal to one vertical slope and covered with soil and seeded. No additional fill should be dumped.
5. Corrective measures are necessary to bring this site into compliance with the permit and approved operations
plan and should be completed within 30 days' receipt of this inspection report.
