STATUS OF PERMIT:
Notified LCID issued in 2005 to Jeff Wyers, Nash Brick Company; company and property bought by Daniel Britt,
Carolina East Enterprises, Inc. and transferred on November 1, 2019. The required notified land clearing and inert
debris paperwork with the owner/operator name change was NOT submitted to the Section.
PURPOSE OF SITE VISIT:

STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
15A NCAC 13B .0201 (c), "No solid waste management facility shall be established, operated, maintained,
constructed, expanded, or modified without a valid permit issued by the Division for the specified type of activity. It
is the responsibility of every owner or operator of a proposed solid waste management facility to apply for a permit
for the facility."
During the September 2020 inspection, the onsite representative, Mr. Jeff Wyres, was provided a hard copy of the LCID
notification form that would need to be completed by the owner, Mr. Daniel Britt. Mr. Britt DID NOT submit the required
notification form prior to the LCID rule readoption date of January 1, 2021; therefore, the facility does not have a valid
permit to operate. CEASE accepting waste at this site. If you wish to continue to operate, you must apply for a permit

using the criteria as identified in 15A NCAC 13B .0566. The facility may also choose to close in accordance with 15A
NCAC 13B .0567.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
A copy of the new LCID rules, which became effective on January 1, 2021, are provided with this report. Please read
through the rules and contact me if you have any questions. Based on rule 15A NCAC 13B .0563 (6), within 5 years of
the effective date, notified LCID landfills will need to be properly closed or obtain a permit from the Division of Waste
Management.
ADDITIONAL COMMENTS
1. The total disposal area for this facility will be under 2 acres in size.
2. 15A NCAC 13B .0201 (g), "Disposal area boundaries for landfills permitted in accordance with Section .0500 or
.1600 of this Subchapter shall be delineated with stationary markers affixed to the ground. The markers shall be
of height and spacing so that they are distinguishable from the surrounding landscape, and so that the adjacent
markers are visible when standing at a marker." One edge of waste marker was observed near the northeastern
corner of the waste disposal area. A presumed second marker, flagging in a tree even with the previously identified
EOW marker, was identified near the northwestern corner Permanent edge of waste markers need to be installed and
visible around the entire limits of the LCID.
3. 15A NCAC 13B .0566 (1), "The facility shall only accept those solid wastes which it is permitted to receive."
During this inspection, plastic piping, tires, landscape fabric, plastic sheeting, asphalt shingles, and painted brick were
observed within the waste footprint. The nonconforming wastes need to be removed from the waste stream and properly
disposed of at a facility permitted to receive that waste type.
4. 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three
horizontal to one vertical at any time." The side slopes of the working face were observed to be mainly vertical and
uncovered during the inspection. The side slopes need to be properly graded and covered with soil. Ensure that the
waste is covered with a minimum of six inches of soil monthly or when the working face reaches 1 acre in size. The
side slope of the excavation along the southwestern side of the LCID was identified to be nearly vertical. The excavation
side slopes also need to be graded to a three horizontal to one vertical ratio.
5. Signage at the facility was found to be overgrown with vegetation. The vegetation needs to be removed from the sign,
so that information can be read.
6. The access roads have been repaired and constructed of all-weather material and properly maintained.
7. An area of broken concrete comingled with plastic sheeting, treated wood and metal was located outside of the waste
footprint, near the northeastern corner of the Site. Some of the concrete was painted. This comingled concrete waste
needs to be disposed of at a facility permitted to receive the waste. This comingled concrete waste CANNOT be placed
within the LCID. The comingled concrete waste needs to be removed and properly disposed of at a facility permitted
to receive that waste type.
8. A pile of sawdust material, possibly chicken litter, was observed near the comingled concrete waste. The facility is not
permitted to receive this type of waste. The sawdust material needs to be disposed of at a facility which is permitted to
receive the sawdust material.
9. This facility must be closed in accordance with 15A NCAC 13B .0567, Closure and Post -Closure Care
Requirements for LCIDLFs.
10. To operate a LCIDLF in the future, you must apply for a permit from the Solid Waste Section.
11. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be
completed within 30 days' receipt of this report. The Solid Waste Section will conduct a follow-up inspection in
30 days to ensure issues noted in this inspection report have been addressed.
