Routine – Mr. Oaks has requested that the status for this site become “Active” again.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Met with Mr. Oaks in regards to this permitted site becoming “Active” again. No septage activity is occurring at
this time and there is no definite date of when septage activity will begin again. There is currently a valid permit
for this site, but it only covers Field #2. Field 2 currently has a significant amount of johnson grass on it and
the required posts are not present. Fields 1 & 3 also have vegetation other than fescue on them. Field 1 has some
field markers posted and Field 3 does not. Discussed the steps needed to possibly include all three field areas in
the permit which are – fescue shall be adequately established on the fields (Mr. Oaks stated that the fields
would be reworked this fall) - fields markers shall be adequately posted to designate the field separations
and required setbacks (this should be done after the fields are reworked this fall) - and also soil samples
(to include the heavy metals analysis) shall be taken which will be a sample box for each field. The site
shall also be reGPS’d later this year for an accurate map/acreage. Enclosed are items that are needed for the
permit to be redone to include fields other than just Field 2.
2. The required signs are posted and the access road is adequate.
3. Discussed the required continuing education class hours that are needed before the end of this year.
