STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A SEE COMMENTS ON BACK The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. Met with Mr. Oaks in regards to this permitted site becoming “Active” again. There is currently a valid permit for a treatment facility, but no dewatering box is present on site at this time. No septage activity (such as storage) is occurring at this time and there is no definite date of when septage activity will begin at this facility. Tanks #1, #2, & #3 are covered under current permit. Tank #1 currently has holes along the top of the end piece. Discussed with Mr. Oaks that Tank #1 shall be repaired before any storage of septage occurs – please inform this office when this tank is repaired. The other two permitted tanks appear structurally sound. Other tanks at this location are for the storage of sludge and waste types other than septage. 2. The required “No Trespassing” signs are posted at the property entrance. The access road is adequate. 3. The approved setbacks are being met. No significant changes in the site since the last inspection. 4. Excess vegetation shall be removed from around the three permitted storage tanks (including the tree hanging down on the top of Tank #1). 5. Also discussed the repermitting of the SDTF-60-11 (on Mr. Oaks property) in Charlotte under the name of Liquid Waste Inc.
