Kirksey Road Landfill — Closed

Dear Mr. Wagner:
Burke County and the City of Morganton are in receipt of the above -referenced letter
dated 2/17/2014 and received via email the same day. My response to the NOV is as
follows:
1) By failing to monitor the Burke County Animal Shelter for the
presence of landfill gas in accordance with the Solid Waste
Management Rules, Burke County and the City of Morganton have
violated 15A NCAC 13B .0505(1)(b).
Response to the above violation — Joyce Engineering was notified of the violation
nn nnnnr1av FPhruary 17. 2014 and was on -site at the Burke County Animal
the next day, Thursday February 20 2014 was forwarded to you by Van
Burbach w/Joyce Engineering at 1.54 pm via email. Results of the monitoring
indicated no methane was detected at the Burke County Animal Shelter. Joyce
Engineering indicated in the cover letter transmitting this monitoring report that
the BC Animal Shelter would be monitored guarterly when the closed Kirksey
Landfill is monitored A copyof the letter and report is attached.
2) By failing to prevent surface water from becoming impounded over
waste, Burke County and the City of Morganton have violated 15A NCAC
13B .0505(5)(b).
Response to the above violation — Staff has attempted unsuccessfully to have
dirt delivered to the site over the last year and one half while two construction
projects were under construction very near our project. Those projects are the
City of Morganton Wastewater Treatment Plant Renovations and the Burke
County Consolidated 911 Center. I spoke to the previous Water Resources
Director and to the Contractor doing the work at the WWTP project and was
unsuccessful in getting any of the material, even though Burke County Friends
for Animals got a good bit of the material (and was placed just to the right of the
entrance to the closed landfill). I was also told that there may be some waste
material on the County's Consolidated 911 Center project but that also did not
materialize. I discussed ditch cleaning material with NCDOT Maintenance
Engineer Tim Anderson and to date, no material from this activity has been
generated After receiving the NOV. I contacted Mr. Scott Lookadoo, Morganton
Public Works Director and asked if there was any material available from any of
the City's adjacent properties that could be utilized. At this time, I have not
received an answer from Mr. Lookadoo. I have also contacted the manager at
the adjacent Vulcan Materials Quarry to see if they had any soil available at an
inexpensive cost that we could obtain. Johnny (Vulcan manager) indicated that
they would be doing some stripping of soil in March of this year that might be
available and asked that I and the landfill supervisor visit the quarry in the next
few weeks to see if the material would be suitable (as it would have rock mixed
in with it) I plan to visit Vulcan next week to see if the material is suitable. Once
we actually get the depressions filled in and reseeded we plan to stockpile some
soil at Kirksey to use as new depressions develop so that water is not
impounded in the future.
Compliance Schedule
1. Within fourteen (14) days from receipt of this Notice, Burke County
and the City of Morganton must monitor the Burke County Animal
Shelter for the presence of landfill gas.
Response to Complainace Schedule Item 1 — Methane monitoring was
completed at the Burke County Animal Shelter on Wednesday February 19' and
the report of no detections was transmitted to Mr. Bill Wagner at 1:54 pm
2/20/2014 via email well within the 14 day compliance schedule.
2. Within sixty (60) days from receipt of this Notice, using best
management practices, Burke County and the City of Morganton, must
take whatever corrective measures are necessary to ensure that water
cannot become impounded over waste at the closed Kirksey Road
landfill.
Response to Compliance Schedule Item 2. — Burke Countv staff will continue to
search for available suitable material to use for filling in of these depressions at
the closed Kirksey Road landfill. Once completed, a stockpile will be maintained
on -site to fill in depressions that form as time goes forward. Vegetation will be
established on these areas as they are filled in to minimize erosion. We will do
whatever is necessary to complete this work within the indicated sixty (60) day
period or by the end of the day on Friday April 18, 2014.
3. As soon as the corrective actions have been successfully
implemented please notify Bill Wagner at:

The purpose of this letter is to provide you with the results of landfill gas monitoring for the
Burke County Animal Shelter, conducted on February 19, 2014. The animal shelter is located on
Kirksey Drive, adjacent to the closed Kirksey Drive Landfill. All accessible areas inside the
building were monitored for the presence of methane gas from the landfill. Particular attention was
paid to monitoring at floor drains and areas where plumbing or utility lines entered the building.
There were no detections of methane anywhere inside the animal shelter building. We also
monitored the landfill gas probe (GP-2) located between the animal shelter and the landfill. There
were no detections of methane in GP-2.
The landfill gas monitoring log and site map are attached. I have also attached an
Environmental Monitoring Reporting Form (EMRF), for submittal to DENR. We will continue to
monitor the animal shelter for methane gas during future quarterly gas monitoring event for the
Kirksey Drive landfill. If we can provide any additional information please do not hesitate to call
