Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. COMMENTS On June 25, 2013, John Patrone met with Dan LaMontagne, Sandy Skolochenko, and Sonya Gilliland to conduct a comprehensive inspection of the Chatham County Permanent Household Hazardous Waste Collection Facility on County Landfill Road in Pittsboro, Chatham County. 1. The household hazardous waste (HHW) collection facility is open 9 months a year (March through November), every 3`d Saturday from 9 am to 3 pm. 2. The facility was not in operation during the inspection. 3. The facility site plan, operations plan, and contingency plan were discussed. 4. The facility HHW generator identification number is NCPH0199501. 5. The facility is permitted to receive HHW from Chatham, Orange, Wake, Durham and other counties in partnership with Chatham County. The facility does not currently accept HHW from conditionally exempt small quantity generators (CESQG) or agricultural/large farm related materials. 6. The facility is prohibited from receiving any other types of waste, including: radioactive wastes, ammunition, explosives, infectious medical waste, and commercial wastes. However, the facility may detain these wastes for appropriate disposal. 7. The collection of HHW is conducted by ECOFLO, Inc., EPA identification number NCD980842132. 8. The facility maintains a record of ECOFLO, Inc. personnel trained in facility operations per 29 CFR, Part 1910. A training record summary sheet and training completion certification is maintained for Melvin Bivens and support staff (Terry Bundy, Darrel L. Coble, Patrick Coker, and Marvin Stennett) trained by ECOFLO, Inc. 9. ECOFLO, Inc. personnel conduct initial screening of material (verbal confirmation with vehicle operator) and record driver name and address. ECOFLO, Inc. personnel unload the material and sort accordingly. 10. The facility has a small building with a secondary containment sump and automatic fire suppression system. Outside of the building there are two concrete pads, each with a secondary containment sump, covered by an all-weather awning. Handheld fire extinguishers are readily accessible. 11. The secondary containment sumps do not have outlets. 12. Prior to a collection event stormwater is pumped -out of the outdoor secondary containment sumps. The outdoor secondary containment sumps, if utilized during a collection event, will be cleaned accordingly. 13. The three containment sumps are not connected, each functions independently of the other. The storage building containment sump has an overflow reservoir, access via cement tile lid behind the building. 14. The facility appeared to have an adequate amount of absorbent material. 15. The equipment and supplies for both the facility and ECOFLO, Inc. are inspected weekly and before a collection event. Inspections documented for collection events occurring July through November 2012 and March through May 2013 were verified. Weekly inspection records were observed. 16. Facility supplies are stockpiled in a storage shed. 17. HHW collected during an event is shipped -out that day or picked -up soon thereafter by ECOFLO, Inc. 18. The facility has an emergency eyewash station. It is a portable unit mounted on the exterior wall of the HHW collection building. Prior to each collection event it is refilled and tested. It is removed and stored when the facility is not in operation/when necessary. 19. During the inspection HHW was stored on site in bulked containers. Accumulated material not shipped -out the day of a collection event is routinely stored for — 90 days. Accumulation labels affixed to 50-gallon drums were observed. Alkaline batteries are collected/stored in the white goods collection area (not associated with the HHW facility). Batteries are shipped to Battery Solutions for processing. 21. The facility maintains records of the amount of HHW received. It is expected that invoices for the material hauled -off by ECOFLO, Inc. mirror the quantity of HHW received. Invoices for material hauled -off were verified for June 16, 2013 through July 12, 2012. ECOFLO, Inc. provides the facility with collection date event totals annually by July Is` 22. A record of material brought to the HHW facility (origin of loads) by residents was verified. 23. The facility annual report (FAR) was submitted to the SWS, dated July 31, 2012. The facility received 54,965 lbs of HHW from July 2011 through June 2012. If applicable, ensure all counties are listed on the FAR from which HHW is received. 24. The facility receives fire extinguishers, helium tanks, propane tanks, lead -acid batteries, used oil, and electronics (computer equipment and televisions, etc.) throughout the year, hauled -off by the local fire department and contract clients. 25. The fire extinguishers, helium tanks, propane tanks, and lead acid batteries are stored under an all-weather awning. 26. Electronics are collected in a roll -off container adjacent to the office, across from the HHW facility. 27. The facility has a storage trailer used for latex paint giveaway. Latex paint deemed reusable during collection events is placed in the trailer. Residents can take paint at no charge by signing a "release from liability form." 28. The annual Chatham County Fire Marshal inspection was conducted on November 30, 2012. 29. The T&S Fire and Security, Inc. semi-annual fire suppression system inspection was conducted on April 29, 2013 and October 26, 2012. 30. The Pittsboro Fire Department will address and emergency at the facility. 31. It is suggested that the facility contingency plan be modified to include language (in all appropriate sections) "... to contact SWS prior to resuming operation after an incident." 32. The facility is located on property containing the Chatham County Solid Waste & Recycling Division office, the closed municipal solid waste (MSW) landfill (19-01), the notified land clearing and inert debris (LCID) landfill (N0069), and per the MSW landfill post closure conditions, the associated yard waste compost operation, and scrap metal, scrap tire, white goods, and recyclables collection areas. 33. The site is secured by chain link fence with lock. 34. The facility has proper signage. 35. The permit expiration date is October 21, 2015. 36.
