STATUS OF PAST NOTED VIOLATIONS: On December 6, 2013 a Notice of Violation (NOV) was issued to Burke County for the following violations: 1. 15A NCAC 13B .0201(a) : This violation has been corrected. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 10 2. 15A NCAC 13B .0201(b): This violation has been corrected. 3. 15A NCAC 13B .0201(c) This violation has been corrected. 4. 15A NCAC 13B .0201(g) : This violation has been corrected. 5. 15A NCAC 13B .0203(d) Item Number 1 of Part IV, Item Number 5 of Part IV, and Item Number6 of Part IV: These violations have been corrected. OBSERVED VIOLATIONS: Applicable Rules and Permit Conditions. Section 59.2(c) of Session Law 2013-413 requires containers used to collect and transport solid waste to "be designed and maintained to be leak -resistant in accordance with industry standards." 15A NCAC 13B .0203(d) states: "By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit." Permit Condition Attachment #1, Part I, #5, of the March 20, 2014 Permit to Operate (DIN 20453) states: "By receiving wastes at this facility the permittee shall be considered to have accepted the terms and conditions of the permit." Permit Condition Attachment #1, Part I, #6, of the March 20, 2014 Permit to Operate (DIN 20453) states, in part, that: "Operations of this solid waste management facility must be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (NCGS 130A-290, et seq.)..." Permit Condition Attachment #3, Part VI, #50 of the March 20, 2014 Permit to Operate (DIN 20453) states, in part that: "All water that comes in contact with solid waste, including vehicle wash -down water, is leachate and must be captured and properly treated before release to the environment. (a) The leachate control system, such as floor drains, leachate collection devices, sanitary sewer connections and leachate storage tanks, must be operational during facility operations. 15A NCAC 13B .0402 (3) states that: "Water that comes in contact with solid waste will be contained on -site or properly treated prior to discharge from the site." Burke County is in violation of Session Law 2013-413 - Section 59.2(c), .0203 (d), and .0402 (3) for permit conditions and Rule violations associated with the release of leachate. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Garbage Disposal Services, Inc. (GDS) is under contract with Burke County to haul municipal solid waste from the Burke County Transfer station to the Foothills Landfill in Lenoir, NC which includes providing the waste transfer trailers; moving the waste trailers in and out of the receiving bay of the transfer station; and hauling the waste from the transfer station to the Foothills Landfill in Lenoir, NC. GDS has subcontracted K.R. Drenth Trucking, Inc. (KRD) to meet the conditions of GDS's agreement with Burke County. 5. The transfer station is permitted to receive municipal solid waste that has been generated from within Avery, Burke, Caldwell, Catawba, Cleveland Lincoln, McDowell, Mitchell, Rutherford and Yancey Counties. 6. Wastes must be transported to the Foothills Municipal Solid Waste landfill in Lenoir, Caldwell County. 7. The transfer station is currently taking in an average of approximately 4,000-tons of municipal waste per month. 8. The "residential" tipping fee at the transfer station is included in each resident's county property tax bill. The "commercial / industrial" tipping fee is $60.00 per ton. 9. Used oil and used oil filters collection receptacles are located on the asphalt apron in front of the transfer station. FCC Environmental out of Concord, NC (800-535-9694) collects the used oil and used oil filers as needed. This area is clean and well maintained. (Photo #9) 10. There are multiple roll -off boxes staged outside of the transfer station for the collection of recyclable materials. This area is clean and well maintained. (Photo #10) 9. Used oil, used oil filter, & used battery collection area located outside of the transfer 10. Random loads of wastes are screened two to three times each week. 12. The transfer station was actively receiving waste during the inspection. (Photo #11) 11. Leachate from the tipping floor is collected in a trench drain that runs across the entire front of the Transfer Station. Leachate from the receiving bay is collected in a trench drain the runs across the width of the east end access. Both of these trench drains feed into a 5,000-gallon underground storage tank that is located off the SE quadrant of the transfer station. The grates to both of these trench drains were free of debris. (Photo # 12) 14. According to the September 2008 Revised Operations Plan (DIN 5821) prepared by Joyce Engineering, Inc. the leachate holding tank has a capacity of 5,000-gallons. 15. The leachate is pumped out and hauled to the City of Morganton's Wastewater Treatment plant by Asbury's Septic Tank Cleaning Service, Inc. of Morganton, NC. (828-433-7104) 16. The interior walls of the transfer station are clean, and in good condition. (Photo #11) 17. Lead -acid batteries had been set aside for recycling outside of the transfer station. (Photo #9, next to the oil recycling tank.) 18. Multiple bait traps had been set outside of the transfer station to control rodents and other vermin. 19. Wind-blown litter was very well controlled. 20. There is a 2-inch water hose on site for fire control. The Chesterfield volunteer fire department also provides fire response for the facility. 21. The tipping floor was in good condition — no cracks and no worn concrete. 22. A roll -off box is maintained at the entrance to the facility, after the scale house, for the collection of household trash and wastes from residents of Burke County. (Photo #18) WHITE GOODS AND SCRAP METAL: 26. White goods and scrap metal are staged on a new concrete pad that is surrounded by a chain -link fence that is topped with concertina wire. (Photo #14). 27. Refrigeration gases (CFCs) are removed from the white goods by OmniSource Southeast LLC. 28. OmniSource Southeast LLC collects the scrap metal as needed. Scrap tires that are still on the rim are disposed of for $2.50 to $3.50 each. 30. There are three semi -trailers on site for the collection, storage and transport of scrap tires to US Tire's facility in Concord, NC. (Photo #19) 31. Scrap tires that are still mounted on rims are collected and recycled by OmniSource Southeast LLC. 17. Looking at the west (exit) end of the receiving bay — the walls are and ceiling grates are clean. YARD WASTE: 18. Area behind the "push wall" in the SE corner of the transfer station is clean & well maintained 32. Yard waste is ground into mulch for use on site and for sale to the public. (Photos # 14) 33. Burke County no longer owns a "tub grinder" for making mulch from yard waste or for making boiler fuel. The county "puts out to bid" the grinding of mulch on an "as needed" basis. 34. Three trailers used for the storage and transport of scrap tires. 20. Mulch pile for sale to the public. ELECTRONICS RECYCLING: 35. Electronic wastes are collected at the transfer station and then moved to an out -building locate east of the landfill offices for segregation, palletizing and loading onto semi -trailers in preparation for shipment to Metech Recycling out of Creedmoor, NC 919-528-6000. Semi -trailed filled with municipal solid waste that was just moved out of the receiving bay & onto the asphalt apron on the WSW sided of the transfer station. Mr. Wagner observed on semi -trailer (believed to be trailer #T-812) (owned and operated by KRD), filled with MSW, parked outside of the Transfer Station's receiving bay. This trailer was leaking leachate was leaking onto the asphalt apron on the west side of the transfer station. It appeared that the trailers filled with MSW are often staged in this location before they are taken to the Foothills Landfill in Lenoir, NC. The leachate was and flowing off the asphalt and onto the grassed area to the SW of the transfer station. There was an area of dead grass measuring approximately 21-ft long by 3 to 5-ft. wide were the flow of leachate would tend to flow. Mr. Wagner conducted a follow-up inspection to determine if there were any additional leaking transfer trailers at the transfer station. While there were no leaking transfer trailers on site at the time of the follow-up inspection, Mr. Wagner did observed wet/stained asphalt in the same location where transfer trailers filled with MSW are staged outside of the Transfer Station waiting to be transported to the Foothills Landfill in Lenoir, NC. Mr. Wagner met with Brock Hall and Greg Watts to discuss the results of Mr. Wagner's inspections. Burke County has contracted with GDS / Republic Services to handle all activities associated with the loading of municipal solid waste (MSW) collected at the Burke County Transfer Station and the subsequent transportation of that waste to the Foothills Landfill in Lenoir, NC. In turn, GDS / Republic Services has sub -contracted these activities to K.R. Drenth Trucking, Inc.(KRD). KRD furnishes the semi -trailers, the tractor -trailers, and the staff necessary to move the MSW form the Burke County transfers station to the Foothills Landfill in Lenoir, NC. [Burke County has been aware of the possible release of leachate from transfer trailers. On July 25, 2011 a Notice of Violation (NOV) was issued to Burke County for violation of "15A NCAC 13B .0105(c) in that it failed to ensure trailers utilized for hauling waste within and from this facility are leak proof and are being maintained in good repair after been previously notified of the issue by the Section.
