On June 7, 2013 a Notice of Violation (NOV) was issued to Burke County for the following violations:

OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0201(a) requires, in part, that "No person shall treat, process, store, or dispose of
solid waste or arrange for the treatment, processing, storage or disposal of solid waste except at a
solid waste management facility permitted by the Division for such activity..."
2. 15A NCAC 13B .0201(b) requires, in part, that "No person shall cause, suffer, allow, or permit the
treatment, storage, or processing of solid waste upon any real or personal property owned, operated,
leased, or in any way controlled by that person without first obtaining a permit for a solid waste
management facility from the Division authorizing such activity..."
15A NCAC 13B .0201(c) requires, in part that "No solid waste management facility shall be
established, operated, maintained, constructed, expanded or modified without an appropriate and
currently valid permit issued by the Division. It is the responsibility of every owner and operator of a
proposed solid waste management facility to apply for a permit for the facility. "
4. 15A NCAC 13B .0201(g) requires, in part that `Permits, including those issued prior to the effective
date of this Rule, shall be reviewed every five years "
15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s) shall be considered
to have accepted the conditions of the permit and shall comply with the conditions of the permit."
5. Item Number 1 of Part IV (General Permit Conditions) states that: "This permit shall expire on
October 1, 2013. Pursuant to 15A NCAC 13B .0201(e), no later than July 1, 2013, the owner or operator
must submit to the North Carolina Department of Environment and Natural Resources, Division of Waste
Management, Solid Waste Section ("Section') for permit review and must update pertinent facility plans
including, but not limited to, the facility operation and waste screening plans. "
6. Item Number 5 of Part IV (General Permit Conditions) states that: "By initiating construction or
receiving waste at this facility the permittee shall be considered to have accepted the terms and
conditions of this permit."
7. Item Number 6 of Part IV (General Permit Conditions) states that: "Construction and operation of
this solid waste management facility must be in accordance with the Solid Waste Management Rules, 15A
NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (NCGS 130A-290, et
seq), the conditions contained in this permit; and the approved plan. Should the approved plan and the
rules conflict, the Solid Waste Management Rules shall take precedence unless specifically addressed by
permit condition."
Burke County is in violation of the seven above stated permitted conditions and rules by operating a solid waste
management facility (transfer station) without an appropriate and currently valid permit to operate.
The expiration date of the most recent Permit to Operate (DIN 5925) was specified in the cover letter to the permit
when it was issued to Burke County on October 3, 2008. Additionally, Ed Mussler (Permitting Branch
Supervisor of the Solid Waste Section) notified Burke County via letter dated January 3, 2013, that the permit for
the transfer station would expire on October 1, 2013.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

4. Greg Watts (Facility Operations Supervisor) was not able to be present during the entire inspection addressed
in this report.
5. Garbage Disposal Services, Inc. (GDS) is under contract with Burke County to haul municipal solid waste
from the Burke County Transfer station to the Foothills Landfill in Lenoir, NC which includes providing the
waste transfer trailers; moving the waste trailers in and out of the receiving bay of the transfer station; and
hauling the waste from the transfer station to the Foothills Landfill in Lenoir, NC. GDS has subcontracted
K.R. Drenth Trucking, Inc. to meet the conditions of GDS's agreement with Burke County.
6. The transfer station is permitted to receive municipal solid waste that has been generated from within Avery,
Burke, Caldwell, Catawba, Cleveland Lincoln, McDowell, Mitchell, Rutherford and Yancey Counties.
7. Wastes must be transported to the Foothills Municipal Solid Waste landfill in Lenoir, Caldwell County.
8. The transfer station is currently taking in an average of approximately 160-tons of municipal waste per day.
9. The "residential" tipping fee at the transfer station is included in each resident's county property tax bill. The
"commercial / industrial" tipping fee is $60.00 per ton.

10. Used oil and used oil filters collection receptacles are located on the asphalt apron in front of the transfer
station. FCC Environmental out of Concord, NC (800-535-9694) collects the used oil and used oil filers as
needed. This area is clean and well maintained. (Photo #1)
11. There are multiple roll -off boxes staged outside of the transfer station for the collection of recyclable
materials. This area is clean and well maintained. (Photo #2)

12. Waste screening records were reviewed. Random loads of wastes are screened two to three times each week.
13. The transfer station was actively receiving waste during the inspection. (Photo #3)

4. Looking down the trench drain that runs across
the entrance to the transfer station.
14. Leachate from the tipping floor is collected in a trench drain that runs across the entire front of the Transfer
Station. Leachate from the receiving bay is collected in a trench drain the runs across the width of the east end
access. Both of these trench drains feed into a 5,000-gallon underground storage tank that is located off the SE
quadrant of the transfer station. The grates to both of these trench drains were free of debris. (Photo #4)
15. According to the September 2008 Revised Operations Plan (DIN 5821) prepared by Joyce Engineering, Inc.
the leachate holding tank has a capacity of 5,000-gallons.
16. The leachate is pumped out and hauled to the City of Morganton's Wastewater Treatment plant by Asbury's
Septic of Morganton, NC. (1765 Hawksbill Court., Morganton, NC 28655, 828-433-7104)
17. The leachate holding tank is typically pumped out three times a month.
18. The interior walls of the transfer station are clean, and in good condition. (Photo #3)
19. Lead -acid batteries had been set aside for recycling outside of the transfer station. (Next to the oil recycling tank.)

20. Multiple bait traps had been set outside of the transfer station to control rodents and other vermin.
21. Wind-blown litter was very well controlled.
22. There is a 2-inch water hose on site for fire control. The Chesterfield volunteer fire department also provides fire
response for the facility.
23. The tipping floor was in good condition — no cracks and no worn concrete.
24. A "new" roll -off box is maintained at the entrance to the facility, after the scale house, for the collection of
household trash and wastes from residents of Burke County. This roll -off box is equipped with a retractable tarp.

SCRAP TIRE COLLECTION:
29. Scrap tires that are still on the rim are disposed of for $2.50 to $3.50 each.
30. There are three semi -trailers on site for the collection, storage and transport of scrap tires to the US Tire
facility in Concord, NC. (Photo #13)
31. Scrap tires that are still mounted on rims are collected and recycled by OmniSource Southeast LLC.

33. Burke County no longer owns a "tub grinder" for making mulch from yard waste or for making boiler fuel.
The county "puts out to bid" the grinding of mulch.
34. Mulch is sold to the public for:

35. The facility is currently conducting a "two -for -one" sale on mulch.
ELECTRONICS RECYCLING:
36. Electronic wastes are collected at the transfer station and then moved to an out -building locate east of the landfill
offices for segregation, palletizing and loading onto semi -trailers in preparation for shipment to Metech
Recycling out of Creedmor, NC (919-528-6000). Photos #15 and #16)
