The receiving bay is not properly sloped towards the trench drain to facilitate the collection and removal
of leachate and stormwater to the leachate holding tank. Much of the stormwater from the roof of the
transfer station is discharged onto the land outside of the exit from the receiving bay. There is no
stormwater collection or control devices (e.g. diversion berms and collection basins) located outside of
receiving bay's entrance or exit. This leads to "flooding" of the receiving bay with several inches of
stormwater. Given that the receiving bay often has waste and debris on its floor, every time the bay
becomes flooded, the stormwater becomes "leachate" as soon as it contacts solid waste. On the morning
of June 4TH, 2013 I observed that the receiving bay of the transfer station was flooded with several inches
of water and that was "contaminated" with municipal wastes that had not been cleaned up after the waste
collection activities of the previous day. (Photos # 16 through # 18)
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per
day may be assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted
here continue, you may be subject to enforcement actions including penalties, injunction from operation of a
solid waste management facility or a solid waste collection service and any such further relief as may be
necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
STATUS OF PAST NOTED VIOLATIONS (List all noted last audit):
On 7/19/12 Burke County was cited for violation of 15A NCAC 13B .0402 in that it failed to failed to maintain or
operate a transfer facility in conformance with the practices specified in their permit. Specifically, Item #7(a) in Part
I (Operating Conditions) of Attachment 3 (Conditions of Operating Permit) of the Permit to Operate dated October 1,
2008 (DIN 5925) states "The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary
condition at all times and must be cleaned at least daily in accordance with the approved Operational Plan. "
This violation has been resolved.
