County is in violation of 15A NCAC 13B .0402 by failing to maintain and operate a transfer station in accordance with their permit. Permit condition #7(c), of Part I, of Attachment 3, states that: "Waste may be stored on -site, in leakproof trailers with watertight covers." (Photos #9 through #11) 2. 15A NCAC 13B .0402 states that: "Any person who mei ntai ns or operates a transfer facility shall maintain and operate the faci I i ty in conformance with the fol I owi ng practices unless otherwise specified in the permit." Burke County is in violation of 15A NCAC 13B .0402 by failing to maintain and operate a transfer station in accordance with their permit. Permit condition #7, of Part I, of Attachment 3, requires that "The facility must not cause nuisance conditions." The receiving bay of the transfer station is need of cleaning. The walls, the ceiling grates, the trench drain grates, and the floor of the receiving bay all need cleaning. (Photos #13 through #15) 3. 15A NCAC 13B .0402(5) states that: "Effective vector control measures shall be applied to control flies, rodents, and other insects or vermin". Burke County is in violation of 15A NCAC 13B .0402(5) by failing apply effective vector control measures to control flies, rodents, and other insects or vermin. The receiving bay is in need of cleaning. The walls, the ceiling grates, the trench drain grates, and the floor of the receiving bay all need cleaning. (Photos #13 through #15) On June 4TH Mr. Wagner observed small swarms of flies and other insects on and in the wastes in the receiving bay. Burke County is in violation of 15A NCAC 13B .0402 by failing to maintain and operate a transfer station in accordance with their permit. Permit condition #7, of Part I, of Attachment 3, requires that "The facility must not cause nuisance conditions." FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 3 of 6 The receiving bay is not properly sloped towards the trench drain to facilitate the collection and removal of leachate and stormwater to the leachate holding tank. Much of the stormwater from the roof of the transfer station is discharged onto the land outside of the exit from the receiving bay. There is no stormwater collection or control devices (e.g. diversion berms and collection basins) located outside of receiving bay's entrance or exit. This leads to "flooding" of the receiving bay with several inches of stormwater. Given that the receiving bay often has waste and debris on its floor, every time the bay becomes flooded, the stormwater becomes "leachate" as soon as it contacts solid waste. On the morning of June 4TH, 2013 I observed that the receiving bay of the transfer station was flooded with several inches of water and that was "contaminated" with municipal wastes that had not been cleaned up after the waste collection activities of the previous day. (Photos # 16 through # 18) You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. STATUS OF PAST NOTED VIOLATIONS (List all noted last audit): On 7/19/12 Burke County was cited for violation of 15A NCAC 13B .0402 in that it failed to failed to maintain or operate a transfer facility in conformance with the practices specified in their permit. Specifically, Item #7(a) in Part I (Operating Conditions) of Attachment 3 (Conditions of Operating Permit) of the Permit to Operate dated October 1, 2008 (DIN 5925) states "The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily in accordance with the approved Operational Plan. Greg Watts (Facility Operations Supervisor) has been on sick leave for several weeks and was not present during any of the inspections addressed in this report. 5. Garbage Disposal Services, Inc. (GDS) is under contract with Burke County to haul municipal solid waste from the Burke County Transfer station to the Foothills Landfill in Lenoir, NC which includes providing the waste transfer trailers; moving the waste trailers in and out of the receiving bay of the transfer station; and hauling the waste from the transfer station to the Foothills Landfill in Lenoir, NC. GDS has subcontracted K.R. Drenth Trucking, Inc. to meet the conditions of GDS's agreement with Burke County. 6. The transfer station is permitted to receive municipal solid waste that has been generated from within Avery, Burke, Caldwell, Catawba, Cleveland Lincoln, McDowell, Mitchell, Rutherford and Yancey Counties. 7. Wastes must be transported to the Foothills Municipal Solid Waste landfill in Lenoir, Caldwell County. 8. The transfer station is currently taking in an average of approximately 215-tons of municipal waste per day. 9. The "residential" tipping fee at the transfer station is $59.12 per ton. The "commercial / industrial" tipping fee is $60.00 per ton. FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 4 of 6 W �_ 1. Used oil & used oil filter collection area located outside of the transfer station. 2. Roll -off boxes staged outside of the transfer station for the collection of recyclable materials (e.g. cardboard, scrap metal, electronics, etc.) 10. Used oil and used oil filters collection receptacles are located on the asphalt apron in front of the transfer station. FCC Environmental out of Concord, NC (800-535-9694) collects the used oil and used oil filers as needed. (Photo #1) 11. There are multiple roll -off boxes staged outside of the transfer station for the collection of recyclable materials. (Photo #2) 12. The transfer station was actively receiving waste during all three inspections. (Photo #4) 13. On June 6TH, before the facility was open, the tipping floor of the transfer station was clear of waste and clean. (Photo #5) 3. Waste being pushed from the tipping floor and into the receiving bay on 6/04/13. 4. Tipping floor before the facility opened for operations on 6/06/13 — very clean and free of any waste or debris. 14. Leachate from the tipping floor is collected in a trench drain that runs across the entire front of the Transfer Station. Leachate from the receiving bay is collected in a trench drain the runs across the width of the east end access. Both of these trench drains feed into a 5,000-gallon underground storage tank that is located off the SE quadrant of the transfer station. The grates to both of these trench drains are partially blocked with debris and must be cleaned. (Photos #5 and #6). According to the September 2008 Revised Operations Plan (DIN 5821) prepared by Joyce Engineering, Inc. the leachate holding tank has a capacity of 5,000-gallons. 16. The leachate is pumped out and hauled to the City of Morganton's Wastewater Treatment plant by Honeywell Septic of Morganton. (4068 Bel Aire Dr., Morganton, NC 28655, 828-433-7867) 17. The leachate holding tank was most recently pumped out on May 20, 2013. This tank is typically pumped out three times a month. 18. (6/04/13) 19. Waste screening is done approximately once a week. 20. Lead -acid batteries had been set aside for recycling outside of the transfer station. (Next to the oil recycling tank.) 21. Multiple bait traps had been set outside of the transfer station to control rodents and other vermin. 22. Wind-blown litter was very well controlled. 23. There is a 2-inch water hose on site for fire control. The Chesterfield volunteer fire department also provides fire response for the facility. 24.
