Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The purpose of this inspection was to conduct a comprehensive audit of the Bladen County notified land clearing and inert debris landfill (LCID). New rules for LCID’s starting January 2021. 2. Signage is still correct and in place. Road currently in good shape. Good job. 3. Unapproved waste was visible on the NLCID, such as painted dimensional lumber and plastic. Please remove and dispose of at appropriate LF. 4. At the time of this inspection, the NLCID needed a considerable amount of cover. Some was staged but exposed waste was over 1 acre. Cover and slope immediately to meet rule. Be sure and establish vegetation in currently unused areas for erosion control. Also, be sure to keep inside the 2-acre notification. EOW markers should be in place to assist onsite staff with keeping inside this area and for Section staff for knowing where the pre-approved area is located. Some EOW markers were visible during inspection. 6. New LCID rules were discussed and the effects this will have on Bladen Counties NLCID and future LCID operations. New LCID rules were sent via email to Mr. McClary on 6/2/2021. Currently, a mine is very close, just south of NLCID, and this will provide cover quickly for the NLCID. Mr. McClary’s vision for the future would be moving over into the mine and combining these two areas. It was suggested that Bladen County start the process with the Sections Permit Engineer, Diana Felix (919) 707-8257, also copied on the email with new LICD rules, and begin discussion for this plan/sites suitability with new rules. This will allow for the County to be “ahead of the game” in either permitting this new LCID or be aware before it’s too late, if it is not suitable for one reason or another, and they can begin searching for a new site. 7. Please pay attention to operational requirements for LCIDs until this site or another is permitted. (15A NCAC 13B .0566) 8. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff in about 45 days. Failure to meet the conditions for compliance may result in Compliance Actions. Mr. Powell is willing to work with the Bladen County, just please communicate well and make progress towards fixing the issues onsite quickly.
