Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS 1. The facility has been closed since 2008. A Post Closure Plan was approved in August of 2009. Mr. Powell emailed Mr. McClary a copy of this plan and copied the Sections Permit Engineer assigned to Bladen County, Diana Felix (919) 707-8257, to connect the two parties about several issues. 2. EOW markers we in place. LF needs more frequent mowing. 3. Some issues onsite were the storage of empty roll off containers on top the closed LF. Nothing should be stored atop the closed LF. Mr. McClary assured these would be removed quickly to another location. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 4. Some rocky soil was also stored on top the LF for road repair in future. This also should not be stored atop closed LF. Please do not store anything on the Closed out LF. Maintain the cap and existing vegetation. Frequent inspections for subsidence and settlement need to be done to ensure the integrity of the cap system. Follow closure plan and communicate with permit engineer and Mr. Powell if any issues arise. 5. Trees of significant size have grown up along the backside, NE side of CDLF, and need removal. Post closure plan addresses some of these issues. Shrubs and grass/weeds should be mowed more regularly etc. Mr. Powell communicated with Sections Permit Engineers Ming Chao, who originally dealt with closure of this facility, and current Engineer, Diana Felix, while copying Mr. McClary, to discuss options with addressing the removal of these trees. Mr. Chao responded with some valuable input on this and other issues but also outlining the process the County should take, in his opinion, as follows: “Please remove all trees inside the landfill disposal area now. Any soil disturbance due to the tree removal activities must be restored according to the original approved closure plan – at least two (2) feet soil cover according to Rule 15A NCAC 13B. 0505(3)(c) according to the approved CQA Report (DIN 8055). After the tree removal project is completed, the County should submit a certified CQA report describing the tree removal and restoration/verification of soil thickness; this report should be prepared by a professional engineer who is registered in the State of North Carolina.” It is recommended that the County cut all the trees inside the waste foot print. The trees with ~ a 6-inch diameter or less should just be cut. Anything larger, and the County should follow the guidelines Mr. Chao presented in email and shown in paragraph above. A good mowing and inspection of the cap system should be done to address any other issues that may have not been visible with the overgrown vegetation so they can be fixed along with the trees.
