• From the inception of the landfill, he waste disposal area(s) have covered portions of two adjacent parcels of
land (PIN 2704 94 8358 and PIN 2714 06 5927), both of which are owned by City of Morganton. The
"southern cell" of the landfill actually straddles the property line that is common to both of these parcels.

OBSERVED VIOLATIONS:
1. 15A NCAC .0510(a) requires that the disposal site be closed in accordance with rule .0505. Rule .0505(1)(b)
states the "Specified monitoring and reporting requirements shall be met." The Landfill Gas Monitoring Plan
(LGMP) — Document ID Number (DIN) 17007 for the Kirksey Dr. Landfill was approved by the Solid Waste
Section (SECTION) on August 7, 2012. The LGMP requires that the Burke County Animal Shelter (Figure 1) be
monitored for the presence of landfill gas. The most recent landfill gas monitoring report submitted to the SWS
does not indicate that the Burke County Animal Shelter was monitored for the presence of landfill gas.

2. 15A NCAC .0510(a) requires that the disposal site be closed in accordance with rule .0505. Rule .0505(5)(b)
states that "Surface water shall not be impounded over or in waste." Multiple instances of water impounded
over waste were observed during this inspection. (Photo #6)
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The property lines and limits of waste have not been delineated with permanent markers. Permanent waste boundary
and property line markers must be installed at landfill. (See the attached May 29, 2009 Memo: Permanent Edge -of -
Waste Markers at Construction and Demolition Debris Landfills, Industrial Solid Waste Landfills and Municipal
Solid Waste Landfills)
Within 60-days of your receipt of this report, please determine and mark the limits of waste of
the landfill; and determine and mark the property lines of the landfill in accordance with the
attached May 29, 2009 Memo.
2. Eight groundwater monitoring wells were located and inspected. All eight wells were properly secured.
3. Wells MW-1, 2, 3S, 313, 6S, and 61) are incased in metal stand -pipes and identified with well tags and IDs.

4. Wells MW-4 & 5 are "flush mounted" wells that are properly secured but are not marked with any
identifying labels. There may be well tags inside of the well lids. (Photos #3 & #4)
5. The entrance to the landfill is controlled by a lockable gate. (Photo #8)
6. The landfill is in need of mowing and there are mature trees and woody vegetation growing over several waste
disposal areas. (Photos #3 - #6)
7. There are several areas of the southern area of waste disposal were water is ponded over waste. (Photo #6)
These areas need to be repaired to ensure that the cap sheds surface water in a controlled manner.
8. Two landfill gas monitoring wells (GP-1 and GP-2) were located and inspected. Both of these wells were
properly secured and identified with IDs and well tags. (Figure #2 and Photo #7)

The integrity of the cap of the landfill must be properly maintained. Proper and necessary maintenance of the cap
includes, at a minimum:
• Mowing the cap as needed to prevent the establishment of trees and woody vegetation;
• Repairing the effects of any surface erosion or subsidence;
• Maintaining the slope of the cap to ensure the controlled shedding of surface water;
• Maintaining the slope of the cap to prevent the ponding of water over waste;
• Establishing and maintain native grasses to stabilize the cap;
• Initiate adequate erosion control measures to prevent excessive on -site erosion; and to prevent silt from
leaving the site.
It is recommended that Burke County develop and implement a written maintenance plan
for the landfill. At a minimum this plan should include a schedule for routine inspections of
the following:
• Vegetation on the cap is mowed sufficiently to allow for inspection of the cap;
• Trees and woody vegetation are prevented from becoming established on the cap;
• Any surface erosion is repaired and re -seeded as necessary;
• Erosion is controlled and repaired to ensure that no silt or sediment leaves the site;
• Any leachate seeps in the cap are repaired;
• Any areas of bare soil are reseeded to establish a vegetative cover;
• Any areas of subsidence of the cap are repaired, re -sloped and reseeded as necessary to
ensure the controlled shedding of surface water from the cap;
• Ensure that the "edge -of -waste" markers are maintained in good repair;
• Ensure that the property line markers are maintained in good repair; and
• Ensure that the groundwater monitoring wells are maintained in good repair.
9. On October 3, 2000 a "landfill gas assessment" at the Kirksey Drive MSW landfill was completed by Joyce
Engineering. The assessment consisted of monitoring for the presence of methane in the headspace of
groundwater monitoring wells MW-1, 2, 4 and 5; in the National Guard Armory; in the Burke County Animal
Shelter (Figure 1); and in two "bar hole probes along the property lines between the landfill and these two
structures...". No methane was detected in any of the sampling locations except for the headspace in MW-2
which contained 10% Methane.
10. A Landfill Gas Monitoring Plan (LGMP) for the Kirksey Dr. Landfill was approved by the Solid Waste
Section (SECTION) on August 7, 2012. The approved plan consists of two existing gas monitoring probes
GP-1 and GP-2 (Figure 2). The LGMP proposed to add four additional probes (GP-3 through GP-6) to the
landfill gas monitoring network. To date the four additional wells have not been installed.
11. The LGMP also requires that the Burke County Animal Shelter (Figure 1) be monitored for the presence of
landfill gas.
12. The LGMP specifies that "the landfill gas probes and structure in the LGMP will be monitored at least
quarterly in accordance with current regulations. "
13. JOYCE Engineering conducted landfill gas monitoring of GP-1 and GP-2 on June 11, 2013, using a RKI
Model GX-2003gas monitor. No exceedances were detected.
14. Water quality monitoring is conducted semiannually. Eight groundwater monitoring wells and three surface water
monitoring locations are sampled and analyzed for the possible presence of Appendix I constituents.
15. JOYCE Engineering conducted water quality monitoring of eight groundwater monitoring wells (MWs 1, 2, 3 S,
3D, 4, 5, 6S & 6D) and three surface water monitoring points (SW 1 through SW3) on June 11, 2013.
