The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff Amanda Thompson and David Powell met with Brandon Brown, Assistant Public Works Director,
at the Town of Carthage Yard Waste Notification (YWN) for inspection.
2. A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Mr. Powell emailed 15A NCAC 13B .1401 - .1408 rules for Mr. Smith for review via email on 6/8/2021.
3. There was a very small amount of unapproved waste comingled through the yard waste onsite. Some paper bags and plastic. Be sure and remove and dispose at a landfill for that waste type. Most was visibly clean. Good job.

4. Onsite discussions included that there isn’t much YW onsite at this time, that’s good. Town can use this material around town for flower beds etc. Material is being separated into windrows for fire control and access for
firefighting equipment. Increasing windrow size slightly was discussed to get a better composted product from the towns efforts. Temperatures are being kept in a Field Log Book, this is good, but the piles must meet the temperature requirements before any material can go to the public. Reference: 15A NCAC 13B .1406
OPERATIONAL REQUIREMENTS. A temperature of 131 degrees for 3 consecutive days’ will must be achieved before this material can be given to the public. Other discussions onsite consisted of how the Town could alter its SOP to achieve compliance with these needs.

5. Renewal is due by June 1, each year and should indicate current operations the town is dong with YWN. Please submit 2021 ASAP.
6. Currently, a sign at the entrance is required according to 15A NCAC 13B .1406 (9).
7. Edge of waste (EOW) markers are needed for the 4 corners of the 2-acre notification. This will help inspector see edge of waste and onsite staff to know the limits of operations for the notification. Suggest tall,
white PVC pipe. Be sure its original 4 corners that meet buffers etc.
8. A gate was present and seemed to be usable if the Town would clear some vegetation around it. However, phone
discussion after inspectors were present, with Mr. Allen, consisted of the Town trading the property the YWN is on for another parcel, no longer using the YWN by closing it, and replacing it with a roll off container that will be periodically be picked up by a contractor and taken to landfill. The Yard Waste notification will need to have all waste removed, utilized according to rules, and go through a closure. The roll off container will need to be covered and be water tight. This will prevent leachate from the container and minimize the wind from removing the waste. Once Mr. Allen gets approval for this idea with Town, contact David Powell and he can assist with closing the YWN. Please note, if this isn’t done, or done quickly, then all of the corrective actions mentioned in this inspection will need to be completed for the YWN to be in compliance. A follow up will need to be done to verify corrective actions have been completed or to confirm all YW has been removed for closure.
9. Town may want to give the new process a trial run before closing YWN and loosing that ability until sure it will work to the needs of the Town.
