The property is recorded in Deed Book 00816, Page 0170. PURPOSE OF SITE VISIT: Partial Inspection to check on compliance STATUS OF PAST NOTED VIOLATIONS: 1. .0564(9) The facility shall meet the following minimum buffer requirements: (b) 100 feet from the disposal area to property lines UNRESOLVED OBSERVED VIOLATIONS: See `Status of Past Noted Violations' The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS: 1. The site appears to have been surveyed with the property line on the east side being partially marked. The surveyed property line appears to be going through the actual LCID which ends up being almost half on the adjacent property, which Myrick does not own. I was never notified that the property line had been marked. 2. I called the daughter, Marilyn Carter, of the adjacent property owner, Eliza Carter, to ask if they had the property surveyed and Marilyn Carter stated that they had not had it surveyed. 3. The site does not appear to have been used since the last inspection. The weeds are growing up along the access path to the LCID. 4. The Edge of Waste Markers have not been replaced on the north, east and south sides. 5. Weeds are growing on the surface and sides of the LCID. There are several bare spots where ground cover must be established to prevent erosion. 6. The whole south side of the LCID, now located where the soil was being mined, is still steeper than a 3:1 slope. 7. It does not appear that the soil pit area where the LCID is now being located has been graded to prevent any ponding water. 8. There does not appear to have been any adequate erosion control measures, structures, or devices utilized to prevent silt from leaving the site and to prevent excessive on site erosion. 9. At this time it appears that the whole south side is being used as the working face. Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. 10. The stumps and other land clearing debris that was exposed on the south side of the LCID have still not been covered with soil, which must be done on a monthly basis.
