You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for
each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement
actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

AREAS OF CONCERN AND COMMENTS:
1. Duke Energy Corporation (DUKE) has contracted CHARA, Inc. (CHARA) to operate the landfill.
2. The edge of waste is identified with permanent markers. (Photo #1.) The edge of liner markers on the outside
perimeter of the landfill are on the top of the perimeter berm, 6.5-ft. outside of the actual edge of waste. Edge of
waste markers are placed on top of the interior berms that separate each of the cells.
3. Cells 1 through 3 are currently in use.
4. Cell #4 — Currently not use. (Stormwater from here is directed to the leachate basin.)
5. Cell #5 — Currently not use. (Stormwater from here to the stormwater basin(s).)
6. Samples from groundwater monitoring wells MW-1S, MW-1D, MW-2S, MW-21), MW-3S, MW-31), TW-1S,
TW-1 D and TW-2 are collected semi-annually and analyzed for the Appendix I constituent list. Samples were last
collected on October 23 and 28, 2013 by DUKE personnel (Figure 2.)
7. Surface water samples will be collected from two locations (SW-1 and SW-2) from Suck Creek which is south of the
landfill.

1. Permanent "Edge of Liner" marker on top of
exterior perimeter berm. (Note the perimeter
stormwater ditch in the foreground.)
2. Looking (W) from the entrance gate at the CCP
landfill, which can only be accessed from within
the Cliffside Steam Station.
9. Leachate is collected then discharged to one leachate basin located outside the (SE) corner of the landfill.
(Figure 2 and Photo #7) The leachate is then pumped to the on -site NPDES permitted ash basin.
10. Weekly logs of rainfall events; landfill inspections for erosion & sediment problems; are maintained by DUKE.
11. Camera inspection of the leachate collection lines was conducted in November and December 2013.
12. There was no evidence that any waste had migrated of the landfill.
13. There was no evidence of any leachate seeps or breakouts on the landfill.
14. There was no evidence of any ponding of water on the landfill.
