OBSERVED VIOLATIONS: 1) Soybeans planted on Fields 5a and 6a. This is a violation of Rule .0842(a)(17) that states “approved nutrient management plans shall be followed.” The nutrient management plan has fescue as the crop for Fields 5a and 6a. Fields 5a and 6a closed to septage application until the fields are reestablished in fescue. Call me when fields are reestablished in fescue. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1) The required signage was present before you get to the site. 2) The access road was in good shape. 3) For the most part, the required markers were present. Need to place the marker for the northeast corner of Field 5b. I placed an orange flag where the marker needs to go. 4) No septage applications noticed outside of the permitted boundaries of the fields. 5) Applications appeared to follow the nutrient management plan. No spot dumps or thick applications noticed. No applications had been made to Fields 5a and 6a. 6) Fescue present on Fields 5b and 6b. Soybeans had been planted on Fields 5a and 6a. Fields 5a and 6a closed until fescue has been reestablished. 7) No objectionable odors noticed today. 8) No issues noticed with the setbacks. 9) Dropped off soil sample boxes at the office. 0BSignage present before you enter site at Field 5a.
