The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITONAL COMMENTS
1. The site is utilized for disposal of off -spec and defective dry cell alkaline batteries generated from the Energizer
Battery Company manufacturing facility located on Art Bryan Drive, Asheboro.
2. The site has two landfill cells, Cell 1 is closed and Cell 2 is the current operational cell.
3. Cell 1 has established vegetative growth and is frequently mowed.
4. Cell 2 is completely enclosed by fencing and the entrance gate remains locked at all times, excepting ingress and
egress of trucks for battery disposal.
5. Proper signage was observed at the entrance gate to the site.
6. The facility has been minimally utilized in the past, currently no batteries are being disposed at the site
7. Reviewed revised Operations Plan approved in the Permit to Construct issued April 22, 2009.
8. Construction for Phase 3A commenced May 2010.
9. Construction was suspended due to discovery of waste in the permitted boundary areas. A plan of action in
conjunction with Randolph County was approved and the waste removed from the site. A permit modification
was submitted for a change in construction design for Phase 3A. The application is being reviewed by the Solid
Waste Permitting Branch.
10. During disposal operations batteries are covered after each incoming load, cover tarps are utilized, and soil cover
is utilized when necessary.
11. Permanent edge of waste markers are installed on both landfill cells.
12. Intermediate soil cover and vegetation has been established on Cell 2.
13. The top of the active landfill is graded to a slope drains for storm water removal. Repairs to the slope drains have
been conducted for effective drainage of storm water
14. Storm water is diverted from the active, Cell 2 landfill area to a sedimentation basin and exits the site via a weir
system.
15. The closed Cell 1 area storm water flows to a central area to a separate drainage area
16. The facility has an active Storm Water Permit. The Storm Water sampling points are identified as Outfall #1 for
Cell 2 and Outfall #2 for the closed Cell 1.
17. Leachate is collected by a sump system, which is periodically pumped and taken to the Energizer Battery
wastewater treatment plant in Asheboro. A sump is located on the down gradient side of both landfill cells.
