Current status of the Land Clearing and Inert Debris Landfill Notification is OPEN PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0566 (4), "Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first." Side slopes should be graded and covered with soil such that a 3:1 slope ratio is maintained. Side slopes must be adequately covered with soil and properly graded. 2. 15A NCAC 13B .0566 (2), "The facility shall only accept those solid waste which it is permitted to receive." There is a significant amount of unacceptable waste observed all over the facility. All unacceptable waste must be removed. It is recommended that staff remove unacceptable wastes when loads are dumped and dispose of these wastes at a permitted facility. 3. 15A NCAC 13B .0566 (3), "Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. " There was exposed waste in many areas of the LCID. Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT :a Waste Management Division of Waste Management ENVIRONMENTAL QUALITY r Solid Waste Section 4. 15A NCAC 13B .0566 (4), `Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first. " The area of exposed waste including the side slopes, appeared to be close to 1 acre and appeared to have not been covered with soil within the one month period. 5. 15A NCAC 13B .0566 (10), "Surface water shall be diverted from the working face and shall not be impounded over waste. " There were areas of ponding water across the site. These areas must be graded to prevent ponding. 6. 15A NCAC 13B .0566 (16), `A sign shall be posted at the facility entrance showing the contact name and number in case of an emergency and the permit number. The permit number requirement is not applicable for facilities not requiring an individual permit." The facility only has a sign stating "State Owned Property". A facility sign with emergency contact name and number is required. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 7. 15A NCAC 13B .0564 (9) b, "The facility shall meet the following minimum buffer requirements 100 feet from the disposal area to property lines... " Ensure all setbacks are established. Permanent, easily visible, within line of sight, edge of waste markers must be established at the facility, showing the less than 2 acre area of waste disposal. 8. The access road is of all-weather construction. 9. The facility is secured by a metal gate with lock. Very good 10. Corrective measures are necessary to bring this LCID landfill facility into compliance and should be completed within 30 days' receipt of this inspection report. Side slopes to be graded at a 3:1 ratio. Waste exposed on the side slopes. Vegetation must be mowed and trees removed from waste unit. 0 Unacceptable waste to be removed from side slope before grading to a 3:1 ratio, covering with soil and seeding.
